18TH STREET PEDESTRIAN IMPROVEMENTS 3741 RMT July 03, 2024 56 either a nuclear moisture-density gauge or cores will be completed as required to provide 1 a minimum of three tests for evaluation. 2 3 For compaction below the required 91% a Non-Conforming Compaction Factor (NCCF) 4 will be determined. The NCCF equals the algebraic difference of CPF minus 1.00 5 multiplied by 40 percent. The Compaction Price Adjustment will be calculated as the 6 product of CPF, the quantity of HMA in the compaction control lot in tons, and the unit 7 Contract price per ton of mix. 8 9 5-04.3(11) Reject Work 10 11 5-04.3(11)A Reject Work General 12 Work that is defective or does not conform to Contract requirements shall be rejected. 13 The Contractor may propose, in writing, alternatives to removal and replacement of 14 rejected material. Acceptability of such alternative proposals will be determined at the 15 sole discretion of the Engineer. HMA that has been rejected is subject to the 16 requirements in Section 1-06.2(2) and this specification, and the Contractor shall submit 17 a corrective action proposal to the Engineer for approval. 18 19 5-04.3(11)B Rejection by Contractor 20 The Contractor may, prior to sampling, elect to remove any defective material and 21 replace it with new material. Any such new material will be sampled, tested, and 22 evaluated for acceptance. 23 24 5-04.3(11)C Rejection Without Testing (Mixture or Compaction) 25 The Engineer may, without sampling, reject any batch, load, or section of Roadway that 26 appears defective. Material rejected before placement shall not be incorporated into the 27 pavement. Any rejected section of Roadway shall be removed. 28 29 No payment will be made for the rejected materials or the removal of the materials 30 unless the Contractor requests that the rejected material be tested. If the Contractor 31 elects to have the rejected material tested, a minimum of three representative samples 32 will be obtained and tested. Acceptance of rejected material will be based on 33 conformance with the nonstatistical acceptance Specification. If the CPF for the rejected 34 material is less than 0.75, no payment will be made for the rejected material; in addition, 35 the cost of sampling and testing shall be borne by the Contractor. If the CPF is greater 36 than or equal to 0.75, the cost of sampling and testing will be borne by the Contracting 37 Agency. If the material is rejected before placement and the CPF is greater than or equal 38 to 0.75, compensation for the rejected material will be at a CPF of 0.75. If rejection 39 occurs after placement and the CPF is greater than or equal to 0.75, compensation for 40 the rejected material will be at the calculated CPF with an addition of 25 percent of the 41 unit Contract price added for the cost of removal and disposal. 42 43 5-04.3(11)D Rejection - A Partial Sublot 44 In addition to the random acceptance sampling and testing, the Engineer may also 45 isolate from a normal sublot any material that is suspected of being defective in relative 46 density, gradation or asphalt binder content.
