September 18, 2024 <br />4 <br /> <br /> <br />Council Member Fosse requested that the resolution be reviewed for gendered language and <br />have it corrected as scrivener’s error prior to the signing of the resolution. <br /> <br />Council Member Rhyne had questions for legal if the council meeting time ordinance that was <br />passed last week could be amended to move up the effective date from October 30, 2024 to <br />October 23, 2024. City Attorney David Hall stated that a new ordinance would need to be written <br />and have three readings prior to approval. <br /> <br />Moved by Council Member Rhyne, seconded by Council Member Vogeli, to amend Section 3, <br />Subsection 4 to strike “and state the reason for the member’s inability to attend the meeting.” <br /> <br /> <br />Roll was called with all council members voting yes, except Council Member Zarlingo who <br />abstained, and Council Member Tuohy who was excused. <br /> <br /> Motion carried. <br /> <br />Council Member Vogeli made a motion, seconded by Council Member Bader to request legal to <br />draft and amend a new council meeting time ordinance to change the effective date from <br />October 30, 2024 to October 23, 2024. <br /> <br />After further discussion, the motion was withdrawn. <br /> <br /> <br />Roll was called to pass the resolution, as amended, with all council members voting yes, except <br />Council Member Tuohy who was excused. <br /> <br /> Motion carried. <br /> <br />EXECUTIVE SESSION: <br /> <br />The City Council recessed for an executive session at 6:59 p.m., and began the executive session <br />at 7:01 p.m. Council reconvened at 7:16 p.m. <br /> <br /> SETTLEMENT – DONALD PLUCKER <br /> <br />Moved by Council Member Bader, seconded by Council Member Rhyne, to authorize the Mayor <br />to execute a settlement agreement with Donald Plucker, in the amount of $685,000 for a <br />worker’s compensation claim. <br /> <br />
