City of Everett 31 Street Medicine Team Pilot Program <br />Subcontract of HCA Contract #K7759 <br /> <br />4.44.2 Conquer represents and warrants that it will comply with all applicable local, <br />State, and federal licensing, accreditation and registration requirements and <br />standards necessary in the performance of the Services. <br />4.44.3 EXECUTIVE ORDER 18-03 RIGHTS (MANDATORY INDIVIDUAL <br />ARBITRATION). Conquer represents and warrants that Conquer does NOT <br />require its employees, as a condition of employment, to sign or agree to <br />mandatory individual arbitration clauses or class or collective action waivers. <br />Conquer further represents and warrants that, during the term of this Contract, <br />Conquer shall not, as a condition of employment, require its employees to sign <br />or agree to mandatory individual arbitration clauses or class or collective action <br />waivers. <br />4.44.4 Any written commitment by Conquer within the scope of this Contract will be <br />binding upon Conquer. Failure of Conquer to fulfill such a commitment may <br />constitute breach and will render Conquer liable for damages under the terms of <br />this Contract. For purposes of this section, a commitment by Conquer includes: <br />(i) Prices, discounts, and options committed to remain in force over a specified <br />period of time; and (ii) any warranty or representation made by Conquer to the <br />City or contained in any Conquer publications, or descriptions of services in <br />written or other communication medium, used to influence the City to enter into <br />this Contract.
