ORDINANCE NO. 2393-99 <br /> AN ORDINANCE relating to potentially dangerous and dangerous dogs, amending <br /> section 2 of Ordinance 1228-86, as amended by section 1 of Ordinance 1257-86 (EMC <br /> 6.08.010), amending section 5 of Ordinance 1228-86 (EMC 6.08. 050), adding six new <br /> sections to EMC Chapter 6.08, and repealing sections 3 and 4 of Ordinance 1228-86 <br /> (EMC 6.08.020, .030). <br /> WHEREAS, the City Council finds that it is appropriate for there to be a formal appeal process <br /> when a dog is alleged to be dangerous or potentially dangerous; and <br /> WHEREAS, the City Council finds that it is desirable for there to be consistency in definitions <br /> relating to dangerous dogs between City ordinances and State law; and <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 2 of Ordinance No. 1228-86, as amended by section 1 of Ordinance No. <br /> 1257-86 (EMC 6.08.010), which reads as follows: <br /> Definitions. <br /> As used in this chapter: <br /> A. "Owner" means any person or legal entity having a possessory property right in a dog or <br /> who harbors, cares for, exercises control over, or knowingly permits any animal to remain on <br /> premises occupied by them. <br /> B. "Dangerous dog" means: <br /> 1. Any dog with a known propensity, tendency, or disposition to attack unprovoked, <br /> to cause injury to, or to otherwise endanger the safety of humans or other domestic animals; or <br /> 2. Any dog which attacks a human being or other domestic animal without <br /> provocation; or <br /> 3. Any dog known by the owner to be a pit bull terrier, which shall be defined in this <br /> chapter as any American Pit Bull Terrier or Staffordshire Bull Terrier or American Staffordshire <br /> Terrier breed of dog or any mixed breed of dog which contains as an element of its breeding the <br /> breed of American Pit Bull Terrier, Staffordshire Bull Terrier or American Staffordshire Terrier as <br />
