• <br /> F. "Animal control authority" means an entity acting alone or in concert with other local <br /> governmental units for enforcement of the animal control laws of the city, county, and state and <br /> the shelter and welfare of animals. <br /> G. "Animal control officer" means any individual employed, contracted with, or appointed by <br /> the animal control authority for the purpose of aiding in the enforcement of this chapter or any <br /> other law or ordinance relating to the licensure of animals, control of animals, or seizure and <br /> impoundment of animals, and includes any state or local law enforcement officer or other <br /> employee whose duties in whole or in part include assignments that involve the seizure and <br /> impoundment of any animal. <br /> H. "Police dog" means a dog used by a law enforcement agency specially trained for law <br /> enforcement work and under the control of a dog handler. <br /> I. "Dog handler" means a law enforcement officer who has successfully completed training <br /> as prescribed by the Washington State Criminal Justice Training Commission in police dog <br /> handling. <br /> Section 2: Section 3 of Ordinance 1228-86 (EMC 6.08.020), "Unconfined Dangerous Dog <br /> on Premises of Owner," and section 4 of Ordinance 1228-86 (EMC 6.08.030), "Dangerous Dog <br /> off Premises," are hereby repealed. <br /> Section 3: A new section is hereby added to Everett Municipal Code Chapter 6.08, to reads <br /> as follows: <br /> Potentially dangerous dog or dangerous dog outside enclosure. <br /> It is unlawful for an owner of a potentially dangerous dog or dangerous dog to permit the dog to <br /> be outside the proper enclosure unless the dog is muzzled and restrained by a substantial chain or <br /> leash and under physical restraint of a responsible person. The muzzle shall be made in a manner <br /> that will not cause injury to the dog or interfere with its vision or respiration but shall prevent it <br /> from biting any person or animal. Provided, however, that a dog declared to be potentially <br /> dangerous due to attacking another animal only, and not a human, shall not be required to be <br /> muzzled when outside the proper enclosure. And provided further, that a dog declared to be <br /> potentially dangerous under EMC 6.08.010(B)(3) shall not be required to be muzzled when <br /> outside the proper enclosure. <br /> Section 4: Section 5 of Ordinance 1228-86 (EMC 6.08.050), which reads as follows: <br /> Penalties. <br /> Any person, firm or corporation violating the provisions of Section 6.08.020 or Section 6.08.030 <br /> is guilty of a gross misdemeanor and may be punished by a fine of not more than five thousand <br /> dollars or imprisonment of not more than one year in jail, or by both such fine and imprisonment. <br /> 3 <br />
