<br />ARTICLE 8 CITY'S RESPONSIBILITIES <br />8.1 Authority of the Project Manager <br />8.1.1 A Project Manager’s authority is specific to the Job Order to which he or she <br />is assigned. <br />8.1.2 The Contract Administrator will exercise all authority of the Project Manager <br />with respect to any and all Job Orders at any time. <br />8.1.3 The Contract Administrator will be the City's representative and shall administer all <br />contract documents. With respect to a Job Order, Final Acceptance as provided for <br />in Article 12 will be accomplished by the Project Manager. The Project Manager and <br />the Contract Administrator have the authority to enforce all obligations imposed on <br />the Contractor by the Contract Documents. <br />8.1.4 The Work will be performed in accordance with the Detailed Scope of Work and the <br />Contract Documents. The Project Manager has the authority but not the obligation <br />to reject Work that is defective or does not otherwise conform to the Detailed <br />Scope of Work. <br />8.1.5 The Project Manager is not responsible for and will not have control or charge of the <br />means, methods, techniques, sequences, or procedures of Work, or for safety <br />precautions or programs incidental thereto, these being the sole responsibility of the <br />Contractor. The Project Manager will not be responsible for or have any control or <br />charge of the acts or omissions of the Contractor, Subcontractor, Sub-Subcontractor, <br />suppliers, or any of their agents or employees, or any other persons performing a <br />portion of the Work. <br />8.1.6 City will issue all communications to Contractor through the Project Manager or <br />Contract Administrator, as determined. In case of termination of the employment <br />of Project Manager or Contract Administrator, the City will appoint a <br />replacement(s). <br />8.2 Administration of the Contract <br />8.2.1 Nothing in this Article or elsewhere in the Contract Documents shall be <br />construed as requiring the Project Manager, Contract Administrator, Inspector, <br />consultant, or other representatives of the City to direct or advise the <br />Contractor as to the method or manner of performing the Work. No approval <br />or advice given by the City as to the method or manner of performing the Work <br />or procuring materials to be furnished will constitute a representation or <br />warranty by the City that the result of such method or manner will conform to <br />the Detailed Scope of Work or achieve the desired results. Such approval or <br />advice will neither relieve the Contractor of any of its obligations under the <br />Contract nor create any liability to the City on account of approval or advice. <br />The Project Manager or Inspectors may call to the attention of the Contractor <br />defective Work or Work that does not conform otherwise to the Detailed Scope <br />of Work.
