withheld, delayed or conditioned. Each request from Lessee for consent to a proposed alteration <br /> under this Section 8.3 shall be presented to Lessor in written form,with proposed detailed plans <br /> or schematic drawings prepared by an architect or engineer reasonably acceptable to Lessor. <br /> Section 8.4 Requirements for Any Alteration. <br /> 8.4.1 General. All alterations shall be at Lessee's sole cost and expense and <br /> shall be constructed in a good and workmanlike manner in compliance with all applicable <br /> permits and authorizations and on a lien-free basis. <br /> 8.4.2 Insurance. Lessee or the contractor undertaking any work hereunder <br /> shall obtain and maintain in force at all times during which construction is in progress on the <br /> Premises builder's risk insurance as required under Section 6.2.5, and such insurance shall name <br /> Lessor as an additional insured thereunder. <br /> 8.4.3 Permits. All building permits and other permits, licenses, <br /> permissions, consents, and approvals required to be obtained from governmental agencies or <br /> third parties in connection with any alterations shall be acquired by and at the sole cost and <br /> expense of Lessee. <br /> 8.4.4 Maintain Regional Center. No alternation shall cause the property <br /> comprising the Regional Center to cease qualifying as a"regional center"within the meaning of <br /> Chapter 35.57 RCW. <br /> Section 8.5 No Authority to Bind Lessor's, Lessee's Interest. Neither Lessee nor <br /> any of Lessee's agents, employees, representatives, contractors or subcontractors shall have any <br /> power or authority to do any act or thing or to make any contract or agreement which shall result <br /> in the creation of any mechanic's or materialmen's lien or claim upon or against Lessor or <br /> Lessor's interest in the Premises. Neither Lessor nor any of Lessor's agents, employees, <br /> representatives, contractors or subcontractors shall have any power or authority to do any act or <br /> thing or to make any contract or agreement which shall result in the creation of any mechanic's <br /> or materialmen's lien or claim upon or against Lessee or Lessee's interest in the Premises or the <br /> Regional Center, except where expressly provided in this Lease. <br /> Section 8.6 Hazardous Substances. Lessee shall comply with all federal, state and <br /> local laws, ordinances, rules and regulations relating to the handling, use, generation, <br /> accumulation, storage, transportation, disposal, treatment or sale of all Hazardous Substances (as <br /> defined in this Section 8.6) including those relating to occupational health standards, radioactive <br /> material, and biomedical and biohazardous waste. Lessee shall maintain on a continuously <br /> updated basis and furnish to Lessor on an annual basis (or more often upon reasonable request <br /> from Lessor) an inventory of all Hazardous Substances used, generated, accumulated, stored or <br /> otherwise located on the Premises. <br /> 8.6.1 Lessee shall give notice to Lessor promptly after learning of any <br /> release of any Hazardous Substance on or at the Premises or the Regional Center or surrounding <br /> environment,which release was not made pursuant to or in conformance with the terms of any <br /> 16 <br /> GROUND LEASE COE--EPFD <br />
