(b) <br />(iv)The Loan Agreement provides that EGM must cause the Property to be <br />physically ready for Project operation no later than December 31, 2026, which <br />must include capacity for 65 beds of emergency bridge housing and capacity <br />for up to an additional 60 emergency severe weather shelter beds on the <br />Property. <br />If the Property is not physically ready for Project operation by December 31, <br />2026, or later date as approved in writing by the County, the City, after City <br />County consultation and County approval in writing, will seek remedies against <br />EGM, including without limitation acceleration of the Loan provided under the <br />Loan Agreement, action under the Note and Deed of Trust, and/or <br />enforcement of the Use Restriction Covenant. <br />If the Property is physically ready for Project operation by December 31, 2026, <br />then the Loan will be forgiven as of December 31, 2026, all as set forth in the <br />Loan Agreement. <br />Use Restriction Covenant. The Use Restriction Covenant, which is attached to the <br />Loan Agreement as an exhibit and which will be recorded against the Property, <br />provides the following regarding Project operation: <br />(i)EGM must ensure that the emergency bridge housing on the Property serves <br />homeless persons as defined at RCW 43.185C.010(12). EGM must ensure that <br />the Property provides space for onsite health services for the individuals <br />residing in the Property's emergency bridge housing; with behavioral health <br />services offered onsite to individuals. <br />(ii)EGM must ensure coordination with onsite behavioral health providers for the <br />provision of services for individuals residing in the Property's emergency <br />bridge housing. <br />(iii)EGM may use the Property for uses not related to emergency bridge housing <br />or to other Project services required in this Agreement, so long as those other <br />uses do not interfere with emergency bridge housing or with such other <br />required Project services. <br />(iv)EGM will comply with all applicable federal, state and local laws, ordinances, <br />and regulations in undertaking the Project and in activities funded in whole or <br />in part with funds provided through this Agreement. <br />(v)Because the Loan is provided pursuant to RCW 82.14.460 and sec 4 '.25.050, <br />EGM must ensure that the Project includes coordinated chemical <br />dependency or mental health treatment program or services. <br />(vi)EGM must have a management plan approved by the City always in place for <br />operation of the Project. <br />4
