1111.1"- ORDINANCE NO. lt40 1 An Ordinance providing for the improvement of Summit Avenue, 2 from Everett Avenue to the south line of 2Oth Street, by grading to 3 proper grade, construction of concrete pavement and doing all other 4 work necessary to make a complete improvement, creating an assess- 5 ment district, creating a Local Improvement District Fund therefor, 6 and providing that payment for said improvement be made by special 7 assessment on the property in said District under the mode of pay- 8 merit by bonds. 9 Whereas, a majority petition of the property owners, petition- 10 ing for said improvement, has heretofore been filed with the Comm- 11 issioner of Public Works and said Commissioner has found the things 12 set forth in said petition to be true, and 13 Whereas, said Commissioner of Public Works has filed with the 14 City Council all data and information, as required by law, and 15 Whereas, said Commissioner of Public Works has recommended to 16 the City Council that said improvement petitioned for be made, and 17 it appearing to the City Council that public convenience and nec- 18 essity* requires such improvement to be made, now therefore 19 20 THE CITY OF EVERETT DOES ORDAIN. 21 Section 1 : That Summit Avenue, from Everett Avenue to the 22 south line of 2Oth Street, be improved by grading to proper grade, 23 construction of concrete pavement, and doing all other work necess- 24 ary to make a complete improvement according to the plans and spec- 25 ifications prepared under the direction of the City Engineer, which 26 plans and specifications are hereby adopted and approved. 27 28 Section 2: That the cost and expense of such improvement in- 29 eluding all necessary incidental expenses shall be borne by and 30 assessed against the property included in the assessment district 31 herein created in accordance with law.
