411 • <br /> �r � 1 <br /> PLANNING DIRECTOR DETERMINATION <br /> REVI 17-018 <br /> August 24,2017 <br /> The City of Everett Planning Director.grants approval of a request by Leonid Linnyk to construct a <br /> 940 square foot addition to a single family residence, creating approximately 600 square feet of new <br /> impervious area,within a 150 foot stream buffer at 10705 Holly Drive with the following conditions: <br /> 1. Enhance the area to the east of swamp creek as shown on the buffer enhancement plan by <br /> Acre Environmental Consulting, LLC dated May 19, 2017. Enhancement must be completed <br /> prior to issuance of building permits or may be completed after issuance of building permits if an <br /> assurance device worth 300%of the cost of planting is provided to the City of Everett. ?' <br /> 2. The existing five foot chain link fence as shown on the approved site plan must remain. Two <br /> Critical Area signs must be placed on the fence. They are available for purchase at the City of <br /> Everett Permit Services Counter. <br /> 3. Monitoring and maintenance of the mitigation plantings shall abide the project monitoring <br /> program included in.the Critical Area Study and Buffer Mitigation Plan by Acre Environmental <br /> Consulting,LLC dated May 19,2017. <br /> 4. Provide a recorded Critical Area Protective Covenant designating the buffer prior to issuance of <br /> the building permit. <br /> Subsection 37.170.0 of the City of Everett Zoning Code gives the Planning Director the authority to <br /> reduce the standard stream buffer width up to 50% only when there has previously been substantial <br /> legal alteration of the stream's buffer on the subject lot or adjoining lots resulting in the existing <br /> buffer being unvegetated, sparsely vegetated, or vegetated with invasive species and when the <br /> remaining buffer is enhanced sufficiently to improve the functional values of the buffer. The <br /> Planning Director approved the reduced buffer based upon information contained in a study prepared <br /> by Acre Environmental Consulting,LLC including the following: <br /> 1. The subject property was developed with a single family residence as part of the short plat for <br /> Olympic Bank within the larger plat of Rancho: Intercity in the early 1980s which predates <br /> current critical area regulations. The backyard has been maintained with lawn and garden. <br /> Swamp Creek is located on the subject property and the entire site is located within the 150 foot <br /> stream buffer. An associated Category II wetland is also located on the western portion of the <br /> site and extends off-site to the south. <br /> 2. According to the report by Acre Environmental Consulting; LLC, the maintained lawn and <br /> garden provide a low level of functions and value to Swamp Creek'and the wetland. To mitigate <br /> for construction of the proposed addition, the Applicant is proposing approximately 600 square <br /> feet of wetland enhancement by cutting back invasive and non-native species and creating plant <br /> islands with willow whips.
