f ORDINAATCE NO. 19'48 1 An Ordinance providing for the improvement of Rainier Avenue 2 from 22nd street to 23rd street by slagging; creating an assessment 3 district ; creating a Local Improvement District Fund therefor, and 4 providing that payment for said improvement be made by special assess 5 ment on the property in said district, by the mode of "Imumediate 6 Payment" . 7 Whereas, a majority petition of the property owners, petitioning 8 for said improvement, has heretofore been filed with the Commissione 9 of Public Works, and said Commissioner has found the things set forti 10 in said petition to be true, and 11 Whereas, said Commissioner of Public Works has filed with the 12 City Council all data and information in regard to said improvement , 13 as required by law, and 14 Whereas, said Commissioner of Public Works has recommended to 15 the City Council that said improvement petitioned for be made, and it 16 appearing to the City Council that public convenience and necessity 17 requires such improvement to be made, now therefore 18 THE CITY OF EVERETT DOES ORDAIN: 19 20 Section 1 : That Rainier Avenue from 22nd street to 23rd street 21 be improved by slagging, according to the plans and specifications 22 prepared under the direction of the City Engineer, which plans and 23 specifications are hereby adopted End approved. 24 Section 2: That the cost and expense of such improvement, in- 25 eluding all necessary incidental expenses shall be borne by and 26 assessed against the property included in the gssessrrent district 27 herein created in accordance with law. The City of Everett shall no 28 be liable in any manner for any portion of the costs and expenses of 29 such improvement. 30 31 -1-
