• i <br /> ORDINANCE NO. 197 <br /> • 1 An Ordinance providing for the improvement of twenty-first Stre:, <br /> 2 <br /> from Grand Avenue to Rucker Avenue, by the removal of old lumber and <br /> 3 slagging; creating an assessment district; creating a Local Improve- <br /> 4 mutt District Fund therefor, and providing that payment for said <br /> 5 <br /> improvement be made by special assessment on the property in said <br /> 6 District by the mode of "Immediate Payment" . <br /> 7 Whereas, a majority petition of the property owners, petitioning <br /> 8 <br /> for said improvement , has heretofore been filed with the Commissioner <br /> of Public Works, and said Commissioner has found the things set forth <br /> 9 <br /> 10 in said petition to be true, and <br /> 11 Whereas, said Commissioner of Public Works has filed With the <br /> 12 City Council all data and information in regard to said improvement :s <br /> 13 required by law, and <br /> 14 Whereas, said Comissioner of Publi c Works has recommended to <br /> the City Council that said improvement petitioned for be made, and it <br /> 15 <br /> appearing to the City Council that Public convenience and necessity <br /> 16 <br /> 17 requires such improvement to be made, now therefore <br /> 18 THE CITY OF LV:ITT DOES ORDAIN: <br /> 19 <br /> Section 1 : that twenty-first Street from Grand Avenue to Rucker <br /> 20 <br /> Avenue be improved by the removal of old lumber and slagging accord- <br /> 21 <br /> ing to the plans and specifications prepared under the direction of <br /> 22 <br /> the City Engineer, which plans and specifications are hereby adopted <br /> 23 <br /> and approved. <br /> 24 <br /> 25 Section 2: that the cost and expense of such improvement, in- <br /> 26 eluding all necessary incidental expenses shall be borne by and assess- <br /> 27 ed against the property included in the assessment district herein <br /> 28 created in accordance with law. The City of Everett shall not be <br /> 29 liable in any manner for any portion of the costs and expenses of <br /> 30 such improvement. <br /> 31 <br /> -1- <br />
