• i ORDINANCE NO. 197 • 1 An Ordinance providing for the improvement of twenty-first Stre:, 2 from Grand Avenue to Rucker Avenue, by the removal of old lumber and 3 slagging; creating an assessment district; creating a Local Improve- 4 mutt District Fund therefor, and providing that payment for said 5 improvement be made by special assessment on the property in said 6 District by the mode of "Immediate Payment" . 7 Whereas, a majority petition of the property owners, petitioning 8 for said improvement , has heretofore been filed with the Commissioner of Public Works, and said Commissioner has found the things set forth 9 10 in said petition to be true, and 11 Whereas, said Commissioner of Public Works has filed With the 12 City Council all data and information in regard to said improvement :s 13 required by law, and 14 Whereas, said Comissioner of Publi c Works has recommended to the City Council that said improvement petitioned for be made, and it 15 appearing to the City Council that Public convenience and necessity 16 17 requires such improvement to be made, now therefore 18 THE CITY OF LV:ITT DOES ORDAIN: 19 Section 1 : that twenty-first Street from Grand Avenue to Rucker 20 Avenue be improved by the removal of old lumber and slagging accord- 21 ing to the plans and specifications prepared under the direction of 22 the City Engineer, which plans and specifications are hereby adopted 23 and approved. 24 25 Section 2: that the cost and expense of such improvement, in- 26 eluding all necessary incidental expenses shall be borne by and assess- 27 ed against the property included in the assessment district herein 28 created in accordance with law. The City of Everett shall not be 29 liable in any manner for any portion of the costs and expenses of 30 such improvement. 31 -1-
