ORDINANCE NO. 2402-99 <br /> AN ORDINANCE OF THE CITY OF EVERETT, WASHINGTON, <br /> PROVIDING FOR THE ACQUISITION OF CERTAIN PROPERTY <br /> FOR THE PURPOSE OF CONSTRUCTING THE PROJECT <br /> COMMONLY KNOWN AS THE "41ST STREET OVERPASS ROAD <br /> PROJECT", TOGETHER WITH ALL NECESSARY <br /> APPURTENANCES AND RELATED WORK TO MAKE A <br /> COMPLETE IMPROVEMENT IN ACCORD WITH APPLICABLE <br /> CITY STANDARDS; PROVIDING FOR THE CONDEMNATION, <br /> APPROPRIATION, TAKING AND DAMAGING OF LAND OR <br /> OTHER PROPERTY NECESSARY THEREFORE; DIRECTING THE <br /> CITY ATTORNEY TO PROSECUTE THE APPROPRIATE ACTION <br /> AND PROCEEDINGS IN THE MANNER PROVIDED BY LAW FOR <br /> SAID CONDEMNATION. <br /> WHEREAS, the acquisition of property for and the construction of the 415` Street <br /> Overpass Road Project is an important part of the City's transportation plan, and <br /> WHEREAS, the City has attempted to negotiate the purchase of all necessary right <br /> of way and property rights for the project from the property owners and has reached an impasse with <br /> those owners whose property is hereinafter described, and <br /> WHEREAS, in view of the impasse reached with the property owners, the City <br /> Council has determined to condemn the property which is necessary for completion of the project, <br /> NOW, THEREFORE, <br />
