A copy of the Order is <br /> attached hereto as Exhibit A for your convenience. The purpose of this letter is to respectfully <br /> request a review of the facts of this matter in light of the revisions to relevant code sections of the <br /> 2021 International Residential Code ("IRC") adopted in January 2023 by the State as the <br /> Washington State Residential Code (the "Code"). The 2021 Codes were expected to become <br /> effective July 1, 2023, but the State Building Code Council voted in May to delay the effective <br /> date 120 days, until October 29, 2023. <br /> We are requesting review of the differences between the 2021 IRC and the 2018 IRC as to <br /> those Code sections governing alterations to existing buildings as applied to the work completed <br /> by the previous owner of the Property and to the work contemplated by my clients to become <br /> compliant. Of particular importance are the Code sections within WAC 51-51-4501 (Chapter 45- <br /> Existing buildings and structures) pertaining to the minimum ceiling height of habitable spaces <br /> and other rooms located in a basement, the previous replacement of basement bedroom windows, <br /> and minor alterations to a basement stairwell. Bringing their home into compliance with the 2018 <br /> IRC would require my clients to raise the ceiling height of their basement several inches, an <br /> extremely costly and difficult project. Based upon my review of the 2021 IRC, it appears that my <br /> clients could potentially avoid having to raise the basement ceiling and could reduce the cost of <br /> the remediation work by as much as $200,000.
