• <br /> Exhibit 13 Go Sync Map <br /> Exhibit 14 Exhibit List,dated November 3,2022 <br /> Based on a review of the record,the following findings of fact and conclusions of law hereby <br /> constitute the basis of the decision of the Everett Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Arturo Nicasio Juarez and Elvia Nicasio(Respondents)are the owners of property at 2330 <br /> Melvin Avenue SE,Everett, Washington(subject property),which is in an R-2, Single- <br /> Family Detached Medium Density zone. The current owners purchased the property in May <br /> of 2015. (Exhibit#12, Snohomish County Assessor's Record, dated October 19, 2022 with <br /> structural information) (Exhibit#13, Go Sync Map) (Testimony of Code Enforcement <br /> Officer Cunningham) <br /> 2. Following a referral from City of Everett Permit Services about work done without permits, <br /> City of Everett Code Enforcement Officer Don Cunningham researched available public <br /> records and determined that prior to the Respondents' purchase of the property in 2015, the <br /> residential structure had been heavily altered from a single level, 800 square foot single- <br /> family residence (SFR)with two bedrooms,one bathroom, and an unfinished basement to a <br /> two story, 1,800 square foot structure with four bedrooms,two bathrooms, a covered patio <br /> and rear porch addition. The alterations to the SFR included: new electrical wiring, <br /> plumbing, drywall,and insulation. The previous owner had applied for and was issued a <br /> building permit(B0803-041) in 2008 to replace and extend a patio roof, but the permit <br /> expired without receiving final approval. Permits were never gained for the rear porch <br /> addition,which is evident in a comparison of 2001 and 2020 aerial photographs of the <br /> property. The Respondents had applied for and were issued an electrical permit(E2004- <br /> 090) in 2020 to provide electrical service to a detached gazebo in the rear yard;however, <br /> this permit expired and the work was never finally inspected. On September 12,2022,the City issued a violation citation to the Respondents for violations <br /> of: International Residential Code(IRC)R105.1 Permit Required as adopted by EMC <br /> 16.005.010; International Property Maintenance Code(IPMC) 106.1 Unlawful Acts as <br /> adopted by EMC 16.005.010; and IPMC 108.1.4 Unlawful Structure as adopted by EMC <br /> 16.005.010. Copies of the violation citation were sent via first class and certified mail to the <br /> Respondents' last known address,which Officer Cunningham obtained from the Snohomish <br /> County Assessor's Record. A copy of the violation citation was posted on the property on <br /> September 15, 2022. Each method of service used is independently sufficient to provide <br /> notice pursuant to EMC 1.20.010.C.1.
