8.6 Retention of Data. <br />Stripe is not obligated to retain data af ter the Term, except as (a) required by Law; (b) required <br />for Stripe to perform any post-termination obligations; (c) this Agreement otherwise states; or <br />(d) the parties otherwise agree in writing. <br />8.7 Use of Fraud Signals. <br />If Stripe provides you with information regarding the possibility or likelihood that a transaction <br />may be fraudulent or that an individual cannot be verified, Stripe may incorporate your <br />subsequent actions and inactions into Stripe’s fraud and verification model, for the purpose of <br />identif ying future potential fraud. Please see the S tripe Privacy Center for more information on <br />Stripe’s collection of end-customer data for this purpose and for guidance on how to notify <br />your Customers. <br />8.8 Third Party Data You Provide. <br />If you enable Services or features of Services or functionality that provide Stripe access to <br />data, including Personal Data and Content , from your third party service providers (“Third <br />Party Data”), then you authorize Stripe to access and use the Third Party Data, and you must <br />obtain all necessary rights and consents from the applicable individuals and third parties <br />sufficient to enable Stripe to law fully collect, use, retain, and disclose the Third Party Data. <br />Stripe will use Third Party Data as this Agreement describes and to (a) secure, provide, and <br />update the Stripe services, (b) comply with Law and Financial Partner requirements, and (c) <br />prevent and mitigate fraud, financial loss, and other harm. You must not provide Protected <br />Health Information to Stripe as part of Third Party Data. You are liable for any disclosure of <br />Protected Health Information to Stripe when you provide access to the Third Party Data. <br />9. Data Security. <br />9.1 Controls. <br />Each party will maintain commercially reasonable administrative, technical, and physical <br />safeguards designed to protect data in its possession or under its control from unauthorized <br />access, accidental loss, and unauthorized modification. <br />9.2 PCI-DSS.
