Page 15 of 41State of Washington Department of Ecology <br />Agreement No: <br />Project Title: <br />Recipient Name: <br />WQC-2025-EverPW-00038 <br />Riverpoint Outfall Replacement <br />City of Everett <br />Funding Distribution Summary <br />Recipient / Ecology Share <br />Recipient Share Ecology Share TotalRecipient Match %Funding Distribution Name <br />$$$%42,500.00 50,000.007,500.0015.00SFAP <br />Total $$7,500.00 42,500.00 $50,000.00 <br />AGREEMENT SPECIFIC TERMS AND CONDITIONS <br />N/A <br />SPECIAL TERMS AND CONDITIONS <br />WQC-2024—Water Quality Program Special Terms and Conditions (Update June 2023) <br />SECTION 1: DEFINITIONS <br />Unless otherwise provided, the following terms will have the respective meanings for all purposes of this agreement: <br />“Administration Charge” means a charge established in accordance with Chapter 90.50A RCW and Chapter 173-98 WAC, <br />to be used to pay Ecology’s cost to administer the State Revolving Fund by placing a percentage of the interest earned in an <br />Administrative Charge Account . <br />“Administrative Requirements” means the effective edition of ECOLOGY 's Administrative Requirements for Recipients of <br />Ecology Grants and Loans at the signing of this agreement. <br />“Annual Debt Service” for any calendar year means for any applicable bonds or loans including the loan, all interest plus all <br />principal due on such bonds or loans in such year. <br />“Average Annual Debt Service” means , at the time of calculation, the sum of the Annual Debt Service for the remaining years <br />of the loan to the last scheduled maturity of the loan divided by the number of those years. <br />“Accrued Interest” means the interest incurred as loan funds are disbursed. <br />“Acquisition” means the purchase or receipt of a donation of fee or less than fee interests in real property. These interests <br />include, but are not limited to, conservation easements, access/trail easements, covenants, water rights, leases, and mineral <br />rights. <br />“Build American Buy American (BABA)” means a portion of the Infrastructure Investment and Jobs Act and establishes a <br />domestic content procurement preference for all Federal financial assistance obligated for infrastructure projects after May 14, <br />2022. <br />“Bipartisan Infrastructure Law (BIL)” means funding to improve drinking water, wastewater and stormwater infrastructure. <br />“Centennial Clean Water Program” means the state program funded from various state sources . <br />“Contract Documents” means the contract between the RECIPIENT and the construction contractor for construction of the <br />project. <br />“Construction Materials” means an article, material, or supply (other than an item of primarily iron or steel; a manufactured <br />product; cement and cementitious materials; aggregates such as stone, sand, or gravel; aggregate binding agents or additives; <br />or non-permanent products) that is or consists primarily of, non-ferrous metals, plastic and polymer-based products (including <br />polyvinylchloride, composite building materials, and polymers used in fiber optic cables), (including optic glass), lumber, and <br />drywall. <br />“Cost Effective Analysis” means a comparison of the relative cost -efficiencies of two or more potential ways of solving a water <br />Template Version 12/10/2020 <br />Docusign Envelope ID: F2F2C641-00FF-4CD2-8410-C8E2A1EA5EB0
