Load Reduction Reporting: The RECIPIENT shall complete the “Section 319 Annual Load Reduction Reporting” form in <br />EAGL by January 15 of each year and at project close-out. ECOLOGY may hold reimbursements until the RECIPIENT has <br />completed the form. This form is used to gather information on best management practices (BMPs) installed and associated <br />pollutant load reductions that were funded as a part of this project. <br />D. Time Extension: The RECIPIENT may request a one-time extension for up to 12 months. However, the time extension <br />cannot exceed the time limitation established in EPA’s assistance agreement . In the event a time extension is requested and <br />approved by ECOLOGY, the RECIPIENT must complete all eligible work performed under this agreement by the expiration <br />date. (For Section 319 funded projects only) <br />SECTION 4: CONDITIONS APPLY TO ALL FEDERAL FUNDING AGREEMENTS, INCLUDING SECTION 319, <br />State Revolving Fund (SRF) Equivalency Projects, and SEWER OVERFLOW AND STORMWATER REUSE <br />MUNICIPAL GRANT (OSG) <br />A. Acquisitions: RECIPIENTs shall comply with the terms and conditions of the Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970, 84 Stat. 1894 (1970)--Public Law 91-646, as amended by the Surface <br />Transportation and Uniform Relocation Assistance Act , PL 100-17-1987, and applicable regulations and procedures of the <br />federal agency implementing that Act. <br />B. Audit Requirements: In accordance with 2 CFR 200.501(a), the RECIPIENT agrees to obtain a single audit from an <br />independent auditor, if their organization expends $750,000 or more in total Federal funds in their fiscal year. The <br />RECIPIENT must submit the form SF-SAC and a Single Audit Report Package within 9 months of the end of the fiscal year <br />or 30 days after receiving the report from an independent auditor. The SF-SAC and a Single Audit Report Package MUST be <br />submitted using the Federal Audit Clearinghouse’s Internet Data Entry System available at : https://facweb.census.gov/. <br />C. Archaeological Resources and Historic Properties (Section 106): This requires completion of the Ecology Cultural <br />Resources Review Form, coordination with Ecology Cultural Resources staff , and receipt of the Ecology Final Determination <br />prior to any property acquisition and above and below ground disturbing activities. <br />D. Architectural and Engineering Services Procurement: The RECIPIENT must procure architectural and engineering services <br />in accordance with the federal requirements in Chapter 11 of Title 40, U.S.C. (see <br />https://uscode.house.gov/view.xhtml?path=/prelim@title40/subtitle1/chapter 11&edition=prelim). <br />E Build America, Buy America (BABA – Pub. L. No. 117-58, 70901-52) (Federally funded SRF Equivalency projects only): <br />The RECIPIENT identified by ECOLOGY as receiving federal equivalency funding agrees to comply with all federal <br />requirements applicable to the assistance received (including those imposed by the Infrastructure Investment and Jobs Act <br />(“IIJA”/BIL), Public Law No. 117-58) which the RECIPIENT understands includes, but is not limited to, the following <br />requirements: that all the iron and steel, manufactured products, and construction materials used in the Project are to be <br />produced in the United States (“Build America, Buy America Requirements”) unless (i) the RECIPIENT has requested and <br />obtained a waiver from the cognizant Agency pertaining to the Project or the Project is otherwise covered by a general <br />applicability waiver; or (ii) all of the contributing Agencies have otherwise advised the RECIPIENT in writing that the Build <br />America, Buy America Requirements are not applicable to the project . <br />RECPIENT shall comply with all record keeping and reporting requirements under all applicable legal authorities , including any <br />reports required by the funding authority (such as EPA and/or a state), such as performance indicators of program deliverables, <br />information on costs and project progress. The RECIPIENT identified by ECOLOGY as receiving federal equivalency <br />funding, understands that (i) each contract and subcontract related to the project is subject to audit by appropriate federal and <br />state entities and (ii) failure to comply with the applicable legal requirements and this Agreement may result in a default <br />hereunder that results in a repayment of the assistance agreement in advance of termination and/or repayment of assistance, <br />and/or other remedial actions. <br />Template Version 12/10/2020 <br />Docusign Envelope ID: F2F2C641-00FF-4CD2-8410-C8E2A1EA5EB0
