IPMC 106.1 Unlawful acts. It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any of the provisions of this code. • The conversion of the garage into an additional dwelling unit without permits is an unlawful structure as defined by International Property Maintenance Code(IPMC)108.1.4 and is a violation of International Residential Code(IRC)R105.1 and IPMC 106.1,which reads: IRC R105.1,Required.Any owner or owner's authorized agent who intends to construct,enlarge,alter, repair, move,demolish or change the occupancy of a building or structure,or to erect, install, enlarge, alter, repair, remove,convert or replace any electrical,gas,mechanical or plumbing system,the installation of which is regulated by this code,or to cause any such work to be performed,shall first make application to the building official and obtain the required permit. IPMC 108.1.4 Unlawful structure.An unlawful structure is one found in whole or in part to be occupied by more persons than permitted under this code,or was erected,altered or occupied contrary to law. CORRECTIVE ACTIONS REQUIRED: By 6/4/2024,the Responsible Person(s)shall take the following actions to correct the Code Violations at the Property: • Contact the City of Everett Permit Services Division located at 3200 Cedar Street to submit complete permit applications for all the necessary and required permits to bring the property into compliance. Information on the City of Everett permit application process and required documents can be found at www.everettwa.gov/permits. • When permits are issued,then,correct and complete all of the deficiencies that are present within the structure and have the work inspected and approved, by the Everett City Building Division. Note that all required permits(if applicable)to perform the corrective action must be obtained from the proper issuing agency. CIVIL PENALTIES: If the corrective action is not completed by the date set for compliance, a monetary penalty in the amount of$250 shall accrue for each day or portion thereof that each violation continues beyond the date for compliance set in this Notice and Order, until compliance with the Notice and Order is achieved. (EMC 1.20.190) IMPORTANT NOTE: PAYMENT OF THE MONETARY PENALTY DOES NOT RELIEVE THE VIOLATOR OF THE DUTY TO CORRECT, ABATE OR STOP THE CODE VIOLATIONS AND/OR PAY ANY AND ALL OTHER COST ASSESSED. CosT OF ENFORCEMENT: Per EMC 1.20.180, the City is authorized to recovery any and all costs of enforcement related to ensuring the Property is brought into compliance.
