I <br /> . � , FILE COPY <br /> 1EtL'APt?D <br /> RESOURCES <br /> ENVIRONMENTAL CONSULTING <br /> PROJECT NARRATIVE FOR <br /> ROBIN AND LANCE TALLEY- 9307 18TH AVE W, EVERETT, WA <br /> (CASE No. CE19-0561) <br /> The applicants, Robin and Lance Talley, are responding to a violation citation (Case No. CE19- <br /> 0561) issued by the City of Everett regarding the unpermitted removal of a beaver dam and <br /> streambank vegetation on their property. Applicable Everett Municipal Code (EMC) violations <br /> include violations of EMC 19.37.030(A) and (B), and EMC 19.37.040(B), (D), and (E). A City of <br /> Everett REVII Critical Area Application to correct the unpermitted alterations to the <br /> stream/wetland area is required. Additionally, a State Environmental Policy Act (SEPA) <br /> application is required due to the in-water work that occurred during beaver dam removal. The <br /> City of Everett also requested the applicant to obtain a Hydraulic Project Approval (HPA), if <br /> required by WDFW. A representative of WDFW, Miles Penk, met with Wetland Resources, Inc. on <br /> the subject property on October 3, 2019. WDFW does not accept retroactive HPAs for work that <br /> has already occurred, so an HPA for the subject unpermitted dam removal is not required of the <br /> applicant. However, if future dam removal is pursued, an HPA would be required. During the <br /> meeting, Mr. Penk made suggestions for how to appropriately mitigate for the unpermitted dam <br /> removal, which were incorporated into the proposed mitigation plan. <br /> The applicant proposes to mitigate for the unpermitted dam removal and associated vegetation <br /> impact by restoring vegetation along the impacted segment of stream. This restoration plan is <br /> provided within the Critical Area Study and Buffer Restoration Plan for Talky - 18th Ave W, dated <br /> 11/06/19, and prepared by Wetland Resources, Inc. (WRI).
