Thanks for your patience; we've been researching the property to make sure we're properly addressing <br /> your questions due to the unpermitted work previously completed on the site. I have the following <br /> comments to address the Planning requirements at this time: <br /> • Several landscaping areas have been disturbed over time including removal of required <br /> plantings; those plantings need to be replaced. Originally this was included as a condition of the <br /> permit issued to address the unpermitted addition work on site.A Public Works permit will be <br /> required to re-open the 2nd driveway on High St; Planning is comfortable reviewing the <br /> landscaping as part of the Public Works permit instead, provided the PW permit is applied for <br /> prior to Final of the violation permit.The replacement landscaping would need to match the <br /> landscaping plans originally approved for the site however it may be best to replace in <br /> conformance with current code standards since your goals include a building addition which <br /> would likely trigger conformance at that time anyway. For reference, current landscaping <br /> requirements are identified in EMC 19.35: https://everett.municipal.codes/EMC/19.35. Permit <br /> history including previously approved plans where available can be found via the digital records <br /> center: https://www.everettwa.gov/1785/Digital-Records-Center <br /> • EMC 19.35 requires 10' of Type I perimeter landscaping along the northern property line due to <br /> the adjacent residential zone.The landscaping strip currently tapers off adjacent to the drive <br /> aisle/driveway but would need to be expanded to meet the required 10' of landscaping along <br /> the entire property line.This would need to be identified as part of the landscaping plan <br /> included with your Public Works permit request. <br /> • An addition to the retail building only would be permissible since retail is a permitted use in the <br /> zone.The building addition would be subject to all applicable code requirements of EMC Title <br /> 19, including but not limited to setbacks, building form, parking, etc. Note:since fuel sales is <br /> considered a nonconforming use at this location, any request to expand the existing fueling <br /> infrastructure (pumps, tanks, etc.) would be considered a nonconforming use expansion and <br /> require additional land use application(s)for review/approval. <br /> I have included Terri and Cindy on this email to assist you with questions regarding the Public Works <br /> permit and Building Violation permit as needed.
