r + <br /> #114P-1,, <br /> ORDINANCE NO. 2413-99 <br /> AN ORDINANCE Relating to Stalking and Harassment, Amending Section 1 of <br /> Ordinance 1974-93 (EMC 10.16.050) and Sections 1 (part), 2 of Ordinance 1521-88, <br /> as Amended by Section 1 of Ordinance 2235-97 (EMC 10.23.010), and Adding Two <br /> New Sections to EMC Chapter 10.02. <br /> WHEREAS, the 1999 Washington State Legislature amended the crimes of harassment and <br /> stalking to clarify that electronic communications are included in the types of conduct and <br /> actions that can constitute harassment and stalking; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal Code to <br /> be consistent with state law in this area. <br /> WHEREAS, it is not the intent of the City Council, by adoption of this ordinance, to restrict in <br /> any way the types of conduct or actions that can constitute harassment or stalking. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance 1974-93 Everett Municipal Code section 10.16.050, which <br /> reads as follows: <br /> Stalking. <br /> A. A person commits the crime of stalking if, without lawful authority and under <br /> circumstances not amounting to a felony attempt of another crime: <br /> 1. He or she intentionally and repeatedly follows another person to that person's <br /> home, school, place of employment, business or any other location, or follows the person while <br /> the person is in transit between locations; and <br /> 2. The person being followed is intimidated, harassed or placed in fear that the <br /> stalker intends to injure the person or property of the person being followed or of another person. <br /> The feeling of fear, intimidation or harassment must be one that a reasonable person in the same <br /> situation would experience under all the circumstances; and <br /> 3. The stalker either: <br /> a. Intends to frighten, intimidate or harass the person being followed, or <br /> b. Knows or reasonably should know that the person being followed is afraid, <br /> intimidated or harassed even if the stalker did not intend to place the person in <br /> fear or intimidate or harass the person. <br />
