ORDINANCE NO. 2418-99 AN ORDINANCE Relating to the Unlawful Discharge of Lasers, Adding a New Chapter to the Everett Criminal Code, EMC Title 10. WHEREAS, the 1999 Washington State Legislature created a new crime of Unlawful Discharge of a Laser; and WHEREAS, The legislature has found that lasers are becoming both less expensive and more accessible in our technologically advanced society; and WHEREAS, a person who discharges a laser at the operator of a motor vehicle might cause an impairment of the safety or operation of the vehicle to the point of jeopardizing the safety of the public; and WHEREAS, lasers are also being used to intimidate and threaten other individuals; and WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal Code to be consistent with state law in this area. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: A new chapter is added to the Everett Criminal Code, EMC Title 10, entitled "Unlawful Discharge of Lasers." Section 2: A new section is added to the Everett Municipal Code Title 10, to read as follows: The definitions in this section apply throughout this chapter unless the context clearly requires otherwise. A. "Laser" means any device designed or used to amplify electromagnetic radiation by simulated emission which is visible to the human eye.
