ORDINANCE Page 5 of 18 <br /> <br />equitable or legal title of which has never been transferred to a person who, in good faith, <br />purchases the new motor vehicle for purposes other than resale. <br />I. L. “Noise” means the intensity, duration and character of sounds from any and all sources. The <br />terms "noise" and "sound" can be used interchangeably for purposes of this chapter. <br />J. M. “Off-highway vehicle” means any self-propelled motor driven vehicle not used primarily for <br />transporting persons or property upon public highways nor required to be licensed under RCW <br />46.16A.030. <br />N. “Officially sanctioned” means written approval given by the City. <br />O. “Owner” shall mean any person, agent, operator, firm or corporation having a legal or <br />equitable interest in the property; or recorded in the official records of the state, county or <br />municipality as holding title to the property; or otherwise having control of the property, <br />including the guardian of the estate of any such person, and the personal representative or <br />executor or administrator of the estate of such person if ordered to take possession of real <br />property by a court, as well as a bankruptcy trustee. <br />P "Plainly audible" means any sound for which any of the content of that sound, such as, but not <br />limited to, comprehensible musical rhythms, is communicated to a person using their unaided <br />hearing faculties. For the purposes of enforcement of this code, the detection of any component <br />of sound, including, but not limited to, the rhythmic bass by a person using their unaided <br />hearing faculties is sufficient to verify plainly audible sound. It is not necessary for such person <br />to determine the title, specific words or artist of music, or the content of any speech. <br />K. Q. “Person” means any individual, firm, association, partnership, corporation or any other <br />entity, public or private. <br />L. R. “Property boundary” means the survey line at ground surface which separates the real <br />property owned, rented or leased by one or more other persons and its vertical extension. <br />M. S. “Public highway” means the entire width between the boundary lines of every way <br />publicly maintained by the department of highways or any county or city when any part thereof <br />is generally open to the use of the public for purposes of vehicular travel as a matter of right. <br />N. “Public nuisance noise” means any sound which annoys, injures, interferes with or <br />endangers the comfort, repose, health or safety of others and affects the rights of a community <br />or neighborhood although the extent of the damage may be unequal. <br />O. T. “Receiving property” means real property within which sound originating from sources <br />outside the property boundary is received. <br />P. U. “Sound level” means a weighted sound pressure level obtained by the use of a sound level <br />meter and weighted as specified in American National Standards Institute Specifications, Section <br />1.4-2014.
