highest cash bidder, and may be in bulk, in batches, or item-by- <br />item. We'll hold any excess proceeds from the sale for you for one <br />year from the date of sale. If no claim is made to the proceeds in <br />that year, we may retain the proceeds. However, if your property <br />that we are storing has a cumulative value of $50 or less, we may <br />sell or dispose of your property (except for personal papers, family <br />pictures, and keepsakes) after 7 days from the date that we mailed <br />notice to you of the prospective sale or disposal. We'll send you <br />a 45 day notice before we dispose of any personal papers, family <br />pictures, and keepsakes. After writ of restitution is issued, if we <br />receive timely notice from you or your representative that you want <br />us to store your personal property, we will do so in accordance with <br />the requirements of RCW 59.18.312. <br />3.5 FAILURE TO PAY FIRST MONTHS RENT <br />If you don't pay the first month's rent when or before the Lease <br />Contract begins, or your failure to pay any subsequent rent or other <br />charges owing under this Lease Contract, all future rent will be <br />automatically accelerated without notice and immediately due. We <br />also may end your right of occupancy and recover damages, future <br />rent, reletting charges, attorney's fees, court costs, and other lawful <br />charges, as permitted by law. <br />3.6 RENT INCREASES AND LEASE CONTRACT <br />CHANGES <br />No rent increases or Lease Contract changes are allowed before <br />the initial Lease Contract term ends, except for changes allowed by <br />a written addendum or amendment signed by you and us, or by <br />reasonable changes of apartment rules. <br />If we give you written notice of rent increases or lease changes <br />effective when the lease term or renewal period ends, this Lease <br />Contract will automatically continue month-to-month with the <br />increased rent or lease changes. The new modified Lease Contract <br />will begin on the date stated in the notice (without necessity of your <br />signature) unless you give us written move-out notice under section <br />3.1. <br />a.Renewal offers must be accepted in writing on or before the <br />acceptance date as stated on the renewal offer notice.The new lease <br />must be executed within 5 days of the acceptance or 3 days from <br />the date the lease was generated and sent to you.Failure to execute <br />the new lease will void the offer and the acceptance of a renewal <br />and applicable month-to-month rent or fee will apply following the <br />current lease term end date. <br />b.Month-to-Month premium charge is added to the rent <br />immediately upon initial lease term.If no amount is stated on the <br />renewal offer submitted at least 60 days prior to the termination <br />date of the current lease, the month-to-month premium charge is <br />$300.00 per month over current rent. <br />By initialing below, you acknowledge and agree to the terms in <br />Section 3. <br />City of Everett <br />X <br />13
