Guide Property Management LLC <br />1500 Westlake Ave N • Suite 212 • Seattle, WA 98109 <br />(206) 737-8171 <br />12 <br />Addendum Prohibiting Short- <br />Term Subletting or Rental <br />12.1 ADDENDUM <br />This Addendum ("Addendum") is made part of the Residential <br />Lease Contract ("Agreement") dated 09/01/2024 , and is between <br />the Owner of 600 Ninth ("Owner") and City of Everett , <br />(collectively and individually "Residents"), for the premises at <br />600 9th Ave - 401 <br />Seattle, WA 98104 <br />(the "Leased Premises"), which is located within 600 Ninth (the <br />"Residential Community"). All capitalized terms used but not <br />defined herein shall have the meaning set forth in the Agreement. <br />Where the terms and conditions of this Addendum vary or conflict <br />with the terms and conditions of the Agreement, the terms and <br />conditions of this Addendum shall control. <br />12.2 SHORT TERM SUBLEASE OR RENTING <br />PROHIBITED <br />Without limiting the prohibition in the Lease on subletting, <br />assignment, and licensing, and without limiting any of our rights <br />or remedies, this Addendum to the Lease further supplements and <br />defines the requirements and prohibitions contained in the Lease <br />Contract between you and us. You are hereby strictly prohibited <br />from subletting, and licensing, or renting to any third party, or <br />allowing occupancy by any third party, of all or any portion of the <br />dwelling, whether for an overnight use or duration of any length, <br />without our prior written consent in each instance. This prohibition <br />applies to overnight stays or any other stays arranged on <br />Airbnb.com or other similar internet sites. <br />12.3 PROHIBITION ON LISTING OR <br />ADVERTISING DWELLING ON OVERNIGHT <br />SUBLETTING OR RENTING WEBSITES <br />You agree not to list or advertise the dwelling as being available <br />for short term subletting or rental or occupancy by others on <br />Airbnb.com or similar internet websites. You agree that listing or <br />advertising the dwelling on Airbnb.com or similar internet websites <br />shall be a violation of this Addendum and a breach <br />of your Lease Contract. <br />12.4 VIOLATION OF LEASE AGREEMENT <br />Your Lease Contract allows for use of your dwelling as a private <br />residence only <br />and strictly prohibits conducting any kind of business in, from, <br />or involving your dwelling unless expressly permitted by law. <br />Separately, your Lease Contract prohibits subletting or occupancy <br />by others of the dwelling for any period of time <br />without our prior written consent. Permitting your dwelling to be <br />used for any subletting or rental or occupancy by others (including, <br />without limitation, for a short term), regardless of the value of <br />consideration received or if no consideration is received, is a <br />violation and breach of this Addendum and your Lease Contract. <br />12.5 REMEDY FOR VIOLATION <br />Any violation of this Addendum constitutes a material violation <br />of the Lease Contract, and as such we may exercise any default <br />remedies permitted in the Lease Contract, including termination of <br />your tenancy, in accordance with local law. This clause shall not be <br />interpreted to restrict our rights to terminate your tenancy for any <br />lawful reason, or by any lawful method. <br />12.6 RESIDENT LIABILITY <br />You are responsible for and shall be held liable for any and all <br />losses, damages, and/or fines that we incur as a result of your <br />violations of the terms of this Addendum or the Lease Contract. <br />Further, you agree you are responsible for and shall be held liable <br />for any and all actions of any person(s) who occupy your dwelling <br />in violation of the terms of this Addendum or the Lease Contract, <br />including, but not limited to, property damage, disturbance of other <br />residents, and violence or attempted violence to another person. <br />In accordance with applicable law, without limiting your liability <br />you agree we shall have the right to collect against any renter’s <br />or liability insurance policy maintained by you for any losses or <br />damages that we incur as the result of any violation of the terms of <br />this Addendum. <br />12.7 SEVERABILITY <br />If any provision of this Addendum or the Lease Contract is invalid <br />or unenforceable under applicable law, such provision shall be <br />ineffective to the extent of such invalidity or unenforceability only <br />without invalidating or otherwise affecting the remainder of this <br />Addendum or the Lease Contract. The court shall interpret the <br />lease and provisions herein in a manner such as to uphold the <br />valid portions of this Addendum while preserving the intent of the <br />parties. <br />By signing below, you acknowledge and agree to the terms in <br />Section 12. <br />City of EverettLessee <br />Date Signed <br />X <br />30 <br />02/24/2025
