" CITY LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the "License"), between the City of Everettas Grantor(the"City)and Agostino Construction Inc., 23418 SE 247th.,`Maple Valley, WA 98390 as the Grantee ("Agostino"), relates to an approximately one half of one acre 0.50 acre portion of property owned by the City located at 4015 Railway Ave, Everett, WA(the"Property"). RECITALS A. Agostino desires to utilize property owned by the City for staging and placement of construction materials while performing work for the City's Water Main P Replacement Project("Project"). B. The City is willing to grant Agostino authority to use the City's property D' upon certain terms and conditions. AGREEMENT Co In consideration of mutual benefits and other good and valuable consideration,the receipt (/D and sufficiency of which is hereby expressly acknowledged,the City licenses Agostino to use the Property upon the following terms and conditions: C- Section 1. LICENSED PROPERTY. The specific area of property owned by the City, and subject to this License, is an area and is more fully set forth as depicted in Exhibit A, attached hereto, or as otherwise directed by Roy Harris the City's on-site supervisor. Section 2. TERM. This License shall be effective beginning March 28, 2016, and shall-expire on December 30, 2016,unless terminated-earlier upon 30-days' notice per Section 7, below. Section 3. intentionally Omitted. Section 4. AUTHORIZED USE. Agostino may only use the Property for the purpose of storing, loading, and unloading materials in conjunction with the Project being performed for the City. Incident to this authorized use,Agostino may install temporary fencing in conformance with Section 16,below. page 1
