in the operations, business, properties, conditions (financial or otherwise) or prospects of the <br /> City. The City has developed feasible contingency plans adequate to ensure uninterrupted and <br /> unimpaired business operation in the event of failure of its own or a third party's systems or <br /> equipment due to the Year 2000 problem, including those of its vendors, customers, and <br /> suppliers, as well as a general failure of or interruption in its communications and delivery <br /> infrastructure. <br /> Section 17. Ongoing Disclosure. The Bond is not subject to the Rule, and the City <br /> makes no undertaking regarding ongoing disclosure with respect to the Bond. <br /> Section 18. General Authorization; Ratification of Prior Acts. The Mayor, the Finance <br /> Director, the City Clerk and other appropriate officers of the City are authorized to take any <br /> actions and to execute documents as in their judgment may be necessary or desirable in order to <br /> carry out the terms of, and complete the transactions contemplated by, this ordinance. All acts <br /> taken pursuant to the authority of this ordinance but prior to its effective date are hereby ratified. <br /> Section 19. Severability. In the event that any one or more of the provisions of this <br /> ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate <br /> any other provision of this ordinance or the Bond, but this ordinance and the Bond shall be <br /> construed and enforced as if such invalid provision had not been contained herein; provided, <br /> however, that any provision which shall for any reason be held by reason of its extent to be <br /> invalid shall be deemed to be in effect to the extent permitted by law. <br /> -11- P:\DOT\DOTOYN 99/11/08 <br />
