<br />43 <br /> <br />C. Day laborers will not supervise regular employees nor fill regular vacancies unless mutually <br />agreed upon between the City and Union. <br /> <br />Section 6: Swim Center <br /> <br />In recognition of the year-round, non-seasonal nature of the activities of the Swim Center, the parties <br />agree that the Swim Center shall be exempted from the supplanting language and the time limit provisions <br />identified in Section 2. Although the time limit provisions shall not apply to positions, the time limit <br />provisions and the applicable work permit fee shall apply to individuals. The parties also agree that the <br />City will maintain a minimum of three (3) bargaining unit FTEs assigned to the Swim Center and that the <br />ratio of day laborer hours to regular employee hours is not increased. That ratio is 6.92 day laborer hours <br />for every hour worked by a regular full-time employee. The City will produce a report at the end of each <br />calendar year showing the ratio of day laborer hours to regular employee hours and provide it to the <br />Union. <br /> <br />In addition to the provisions in Section 3, Student Day Laborers employed by the Swim Center may not <br />work more than twenty-five (25) hours per week. <br />
