This is done under a written contract with each <br />district. These contracts are extremely complex and have up to 50-year terms. <br />Negotiating these contracts can take years, as all parties will invest millions of dollars in <br />infrastructure throughout the duration of the agreements. <br />The last round of contracts was executed in the early 1980’s and have since expired with <br />the exception of Silver Lake’s in which a new contract was approved by City Council in <br />2015. This new Silver Lake contract will not expire until 2065. <br />Alderwood’s contract expired in 2021, and a new contract should be brought to Council <br />in 2025-26. Mukilteo’s situation is similar to Alderwood’s. <br />This proposed ordinance will amend the EMC to make clear that the City may continue <br />to provide sewer disposal in the interim between contract expiration and the new <br />contract approval. The ordinance provides that the Public Works Director may <br />determine the rates and charges for this interim service, but in no case will those rates <br />and charges be less than the rates and charges as calculated under the provisions of the <br />expired contract. The ordinance also limits the interim period to five years. <br /> <br />Recommendation (exact action requested of Council): <br />Adopt an Ordinance regarding expired wholesale sewage disposal contracts, amending <br />EMC 14.04.150. <br /> <br />
