I <br /> 1 <br /> CHAPTER 1. INTRODUCTION <br /> ISoundview Consultants LLC (SVC)is assisting Latitude Development LLC (Applicant) on a Fish and <br /> Wildlife Biological Assessment Report and ESA FEMA Floodplain Analysis for a proposed <br /> I commercial project at 315 Riverside Road,Everett,Washington (Snohomish County Parcel Numbers <br /> 29050900300800 and 29050800402500). The subject property is currently owned by the Port of <br /> Everett. The subject property is 21.9 acres in size and is situated in the Southeast and Southwest <br /> Iquarters of Section 8,Township 29 North,Range 05 East,W.M. <br /> The parcel is currently undeveloped and consists mostly of urban compacted fill soils. At this time, <br /> I Latitude Development LLC is proposing to develop the property for business/industrial use and <br /> project activities will comply with the City of Everett Shoreline Management Program (SMP). Per <br /> SMP code 5.1.1, this proposed project is upriver from SR 529 and may be used for nonwater- <br /> I dependent industrial or heavy commercial use and will the project will be concurrent with the Port of <br /> Everett's restoration of a 50 foot buffer along the Snohomish River including a public access pathway. <br /> Additional, the project will have perimeter landscaping, parking and stormwater facilities outside of <br /> I 50 foot offset.The proposed project will develop a highly degraded site and establish a more functional <br /> buffer along the Snohomish River. <br /> I The subject property was investigated for the presence of fish and wildlife habitat and priority and/or <br /> ESA listed species on November 17, 2016, by Jon Pickett, Senior Planner for SVC. The Snohomish <br /> River is designated as a "Shoreline of the State" and has a riparian buffer zone measured <br /> I perpendicularly from the ordinary high water mark on both sides of the water body 250 feet landward <br /> (Washington State Department of Ecology,2011).The currently proposed building is partially situated <br /> within the 250-foot riparian buffer zone of the Snohomish River. Any development actions within <br /> I this buffer zone require compliance with Section 7 of the Endangered Species Act (ESA) through the <br /> Federal Emergency Management Agency (FEMA), as part of the National Flood Insurance Program <br /> (NFIP). Upon evaluation of the proposed projects'planned site improvements, construction actions, <br /> I and buffer restoration, the proposed project is not anticipated to adversely effect ESA-listed species. <br /> Riparian buffer functions will be improved and restored by the Port of Everett; however, the City of <br /> Everett requires assessment and documentation of the potential effects on ESA-listed species and <br /> Icritical habitat to maintain NFIP compliance. <br /> At this time, Latitude Development LLC is proposing to construct an industrial business complex. <br /> I Work near the shoreline and FEMA-insured floodplain requires the proposed project be evaluated for <br /> potential effects on ESA-listed threatened and endangered species.
