Arboricultural Consulting I Wholesale Tree Nursery CONTRACT OF ENGAGEMENT Agreement Regarding Field Work, Consulting Services,and/or Expert Witness Testimony Conditions,and Fees I retain Urban Forestry Services, Inc. to engage in one or more services including, but not necessarily limited to: tree and site evaluation or investigations; prepare written or oral reports; review documents; expert witness testimony in court or arbitration and serve in an advisory capacity to me or my representatives. The nature of this engagement is: Professional assessment of trees on park property- Forest Park- in proximity to residence at 4214 Federal Avenue. Pre quote of$786.96 No work will be done without written or verbal authorization by the contracting agent. A retainer fee may be required to initiate and maintain this contract of engagement. SCHEDULE OF FEES AND TERMS: 1) For work performed and for on-call status:Principle @ $135 per hour,plus expenses: Associate n$135 per hour, .575 cents per mile(automobile);Technical @$85 per hour;Clerical a,$55 per hour. Travel time portal to portal. Photos$1.00 each. Deposition,testimony in court or arbitration hearings,and travel time, Court testimony or deposition at$185 per hour, charged on 4 hr.basis,plus expenses. Fees subject to change after one(1)year from Issue Date. Minimum V2 day charge. 2) Expenses:Actual expenses reasonably and necessarily incurred,e.g.travel,telephone charges,photographics,field and laboratory supplies and fees,and equipment rental will be billed at cost. 3) Terms: o Actual or estimated fees may be required in advance. o All accounts are due in full within 30 days of original statement date. 1.5%finance charge will be added to all past due balances using a simple periodic rate of 1.5%per month on a previous balance,which is an annual percentage rate of 18%. o Urban Forestry Services,Inc.will be fully reimbursed for all reasonable time and costs to collect unpaid invoices, including reasonable and necessary attorney fees,commencing 90 days after original statement date. 4) $1000.00 Retainer Fee required,if checked. 5) Authorization Form to be signed and returned within 30 days from Issue Date. Contracts renewed on a yearly basis. 6) I have read and understand the attached Assumptions&Limiting Conditions that are part of this contract. (initial) It is understood that payment of fees and expenses is not contingent upon the results of any legal action,any findings to be reported,or the occurrence of a subsequent event. For any dispute-resolution service a separate contract of engagement will be required. The contracting party is responsible for any and all fees and expenses.
