The subject property and the wetlands proposed for elimination are located within the <br />service area of the Skykomish Habitat Mitigation Bank. <br />5.0 PROPOSED MITIGATION SITE <br />5.1 MITIGATION SITE SELECTION <br />Washington State Department of Ecology publication #09-06-032, Selecting Wetland Mitigation Sites <br />Using a Watershed Approach, dated December 2009, was used to evaluate the selected mitigation <br />site. The selected mitigation site, Skykomish Habitat Mitigation Bank, is one of the two existing <br />wetland mitigation banks in the Snohomish River basin (WRIA 7). <br />5.2 MITIGATION TYPE AND LOCATION HIERARCHY <br />The applicant carefully considered the mitigation options for the proposed impacts. The <br />following is the hierarchy of mitigation options presented in Section 332.3(b)(2)-(6) of the Federal <br />Compensatory Mitigation for Losses of Aquatic Resources Final Rule and associated rational for proposed <br />mitigation: <br />• Mitigation bank credits — The City of Everett allows the use of mitigation banking <br />under EMC 19.37.120(C)(12). The applicant proposes to use mitigation bank credits for <br />this project. <br />• In -lieu fee program credits - In -lieu fee is not specifically identified in Everett <br />Municipal Code as a potential option for wetland mitigation. In addition, no in -lieu fee <br />program is known to be available in Everett. <br />• Permittee-responsible mitigation under the watershed approach — The <br />applicant chooses to use mitigation banking rather than permittee-responsible mitigation <br />under the watershed approach. Mitigation banking is the most desired mitigation option <br />under this hierarchy. <br />• Permittee-responsible mitigation, on -site in kind — The applicant chooses to use <br />mitigation banking rather than permittee-responsible mitigation, on -site in kind. <br />Mitigation banking is the most desired mitigation option under this hierarchy. <br />• Permittee-responsible mitigation, off -site and out of kind — The applicant <br />chooses to use mitigation banking rather than permittee-responsible mitigation, off -site <br />and out of kind. Mitigation banking is the most desired mitigation option under this <br />hierarchy <br />5. 3 SECTION 332.3(a) (1) COMPLIANCE <br />• Likelihood of ecological success — The applicant is proposing to utilize a mitigation <br />bank. Skykomish Habitat Mitigation Bank is constructed, functioning and successful. <br />• Location of the compensatory mitigation site relative to the impact site — <br />Skykomish Habitat Mitigation Bank is located in the Monroe area of Snohomish County, <br />within the same drainage basin (Snohomish River, WRIA 7) as the impacts.
