INTRODUCTION <br />Tierra was contracted by Wetland Resources to conduct a cultural resources assessment for the <br />Soundview Business Campus Project (the project), located in Section 3, Township 28 North, Range <br />4 East, Willamette Meridian, in Everett, Snohomish County, Washington. The project proposes to <br />divide approximately 39 acres into 5 lots of 4 buildings and a paved area containing 650 parking <br />stalls on Snohomish County Tax Parcel 28040300200100 (Figures 1-3). The project also includes <br />the filling of four wetlands. Mitigation of wetland filling will through use of an off -site mitigation <br />bank. This report has been prepared to assess the effects of the project on cultural resources, in <br />accordance with Section 106 of the National Historic Preservation Act of 1966 (NHPA), as <br />amended. <br />PROJECT INFORMATION <br />Facility Construction <br />The project proposes to construct four buildings and parking lots and install utilities, storm water <br />systems, and a central access road from 36`h Avenue NE. Work associated with the building facilities <br />and roadway would be within the central portion of the site. Project development would require <br />clearing, grading, and grubbing, which would necessitate the removal of trees and heavy <br />undergrowth within the proposed footprint. <br />Tierra understands the APE to be defined as the footprint of construction as described above and <br />illustrated in Figures 1-5. Staging areas are to be located within the APE. <br />REGULATORY CONTEXT <br />National Historic Preservation Act <br />Under Section 106 of the NHPA, agencies involved in a Federal undertaking must take into account <br />the undertaking's potential effects to historic properties (36 CFR 800.16(l)(1)).The project will <br />require a permit from the U.S. Army Corps of Engineers (USACE), a Federal agency, and therefore <br />the project is considered a Federal undertaking. The work performed by Tierra was intended, in part, <br />to assist in regulatory requirements for Section 106 of the NHPA and the implementing regulations <br />in 36 Code of Federal Regulations (CFR) Part 800. A historic property is typically aged 50 years or <br />older and is defined in 36 CFR Part 800.16(1)(1) as follows: <br />... any prehistoric or historic district, site, building, structure, or object included in, <br />or eligible for inclusion in, the NRHP maintained by the Secretary of the Interior. <br />This term includes artifacts, records, and remains that are related to and located <br />within such properties. The term includes properties of traditional religious and <br />cultural importance to an Indian tribe or Native Hawaiian organization and that meet <br />the National Register criteria. <br />The procedures under Section 106 generally require the Federal agency involved in the undertaking <br />to identify the APE, inventory any historic properties that may be located within the APE, and <br />determine if the identified historic properties located within the APE may be eligible to be listed in <br />or eligible for listing in the NRHP.
