. <br /> 2. Existing monitoring wells must be properly abandoned if they are to be covered with fill material. <br /> (SEPA Earth, Water Policies) <br /> 3. Building Height: The grade of this site is being raised an average of 15-17 feet above the existing <br /> grade. The approved topography, which provides the basis for base elevation and building height <br /> calculation, will be the existing grade. Alternatively,the Planning Director may approve a new base <br /> elevation during a future land use permit review if a view analysis is provided analyzing the potential <br /> impacts of development of this site on views from properties on the west side of E. Marine View <br /> Drive and from the City park to the south. The analysis must include cross-sections showing grades <br /> and proposed structure(s). (SEPA Earth, Land and Shoreline Use Policies) <br /> 4. Puget Sound Energy (PSE)has commented that there is an 8-inch,high-pressure gas main within an <br /> easement on the site(see letter of March 28, 2006). No structural or engineering analysis has been <br /> provided to determine how the proposed grading and fill activities (or future structures) would affect <br /> the pipe. In the absence of such information, no filling, grading or heavy equipment traffic may <br /> occur within the easement limits. Prior to any grading or filling activity within the easement, <br /> additional information must be provided to PSE and the City indicating how the proposed <br /> development will affect the gas line. The plans must either demonstrate that the existing line will be <br /> protected, or that suitable provisions have been made for relocation of the line. (SEPA Public <br /> Services and Utilities Policies) <br /> Everett Smelter Site Community Protection Area—Discussion and Mitigation Requirements. <br /> The site is located within the Everett Smelter Site, where soils and groundwater typically contain arsenic, <br /> lead, or cadmium above state cleanup levels. The Everett Smelter Site Upland Area Final Cleanup Action <br /> Plan/Final Environmental Impact Statement Lowland FCAP, incorporated by reference and available at the <br /> City Planning department, describes and adequately analyzes the Everett Smelter Site conditions, land use, <br /> and cleanup plan, including protective measures ("institutional controls")to be used in areas where <br /> contamination may remain after cleanup. The proposed action is located on property where contaminated <br /> soils have not been remediated. However,the proposed action constitutes a remediation action because it <br /> would result in capping of the contaminated soils with more than two feet of clean fill. The Department of <br /> Ecology has issued written comments in support of this method of protecting human health and safety. <br /> Environmental Health—SEPA mitigation measures discussion <br /> To the extent contamination remains on the proposed site, as defined by the Everett Smelter Site cleanup <br /> action plan,this SEPA determination is based on the private or public property owner (and tenant or operator <br /> if applicable) implementing the institutional controls applicable to the property. <br /> These include, at a minimum: (1) following the Snohomish Health District Everett Smelter Site public health <br /> advisory guidelines (www.shd.org/advis/smelter.pdf) for taking precautions when digging into or otherwise <br /> coming into contact with contaminated soils remaining on site; (2) if contaminated soil is excavated and left <br /> on site (including, for example, from tree planting, fence posts, utilities, or foundations), covering this soil <br /> with at least two feet of clean soil and otherwise meeting the "soil profile" for the Everett Smelter Site <br /> (available at the Everett Planning Department or www.ci.everett.wa.us/everettsmeltersite); (3)not giving <br /> away or disposing of excavated soil that is contaminated except to a facility permitted to accept such soil, <br /> 2 <br />
