Snohomish County or other applicable jurisdiction for the development of the Property,
<br />or Declarant's master plan for the development of the Property.
<br />4.9 Security. None of the Association, Declarant, any successor Declarant or
<br />CDCG shall in any way be considered insurers or guarantors of security within the
<br />Property. None of the Association,'Declarant, any successor Declarant or CDCG shall
<br />be held liable for any loss or damage for failure to provide adequate security or
<br />ineffectiveness of security measures undertaken. All Owners and occupants of any Lot,
<br />and all tenants, guests and invitees of any Owner, acknowledge that none of the
<br />Association and its Board, Declarant, any successor Declarant, CDCG or the ACC
<br />represent or warrant that any fire protection system, burglar alarm system or other
<br />security system designated by or installed according to guidelines established by
<br />Declarant or the ACC may not be compromised or circumvented; nor that any fire
<br />protection or burglar alarm system or other security systems will prevent loss by fire,
<br />smoke, burglary, theft, holdup or otherwise; nor that fire protection or burglar alarm
<br />systems or other security systems will in all cases provide the detection or protection for
<br />which the system is designed or intended. All Owners and occupants of any Lot, and all
<br />tenants, guests and invitees of any Owner acknowledge and understand that the
<br />Association, its Board, committees, Declarant, CDCG or any successor Declarant are
<br />not insurers. All Owners and occupants of any Lot and all tenants, guests and invitees
<br />of any Owner assume all risks for loss or damage to persons, to Lots and to the .
<br />contents of Lots, and further acknowledge that the Association, its Board, committees,
<br />Declarant, CDCG or any successor Declarant have made no representations or
<br />warranties, nor has any Owner, occupant or any tenant, guest or invitee of any Owner
<br />relied upon any representations or warranties, expressed or implied, including any
<br />warranty of merchantability or fitness for any particular purpose relative to any fire
<br />and/or burglar alarm systems or other security systems recommended or, installed or
<br />any security measures undertaken within the Property.
<br />4.10 .Utility Lines. Each Owner, occupant, guest and invitee acknowledges that
<br />none of the Association, the Board, Declarant or CDCG shall in any way be considered
<br />insurers or guarantors of health within the Property, and none of the Association, the
<br />Board, Declarant or CDCG shall be held liable for any personal injury, illness or any
<br />other loss or damage caused by the presence or malfunction of utility lines or utility
<br />substations adjacent to, near, over or on the Property. Each Owner, occupant, guest
<br />and invitee assumes all risk of personal injury, illness or other loss or damage arising
<br />from the presence of utility lines or utility substations, and further acknowledges that
<br />none of the Declarant, CDCG or the Association have made any warranties, nor has
<br />any Owner, occupant, guest or invitee relied upon any representations or.warranties,
<br />expressed or implied, relative to the condition or impact of utility lines or utility
<br />substations.
<br />4.11 Landscaping Standards. The entire rear yard and side yard areas of each
<br />Lot within SIMPSON shall be landscaped in accordance with this Section 4.11. Basic
