Mall Way, as well as the westernmost façade of the single story <br /> structure, as depicted in the attached illustrations. <br /> 2.3.3 Architectural modulation shall give the Western façade of the <br /> structures the appearance of not having flat façade surfaces for <br /> substantial portions of its length. Examples of architectural <br /> treatments shall include, but not be limited to, building façade <br /> modulation, orientation of doors and windows, varying use of <br /> building materials and colors, or a combination of techniques <br /> providing the desired effect. Blank walls along the <br /> westernmost building exposures shall be prohibited. <br /> 2.3.4 The "top" of the three-story structure should be treated with a <br /> distinct outline with elements such as a projecting parapet, <br /> cornice or projection. <br /> 2.3.5 Mechanical equipment located on the roof, façade, or external <br /> portion of the structures shall be architecturally screened so as <br /> not to be visible from Interstate 5 or Everett Mall Way <br /> 2.4 Signage. <br /> 2.4.1 Signage for the business shall be in accordance with Zoning <br /> Code requirements for the C-1 zone, with the exception that no <br /> freestanding signs will be allowed adjacent to Interstate 5. <br /> 2.5 Landscaping. <br /> 2.5.1 Type 1 landscape screening shall be provided along the <br /> Northwest, Northeast and East landscape buffers as depicted in <br /> Exhibit A. <br /> 2.6 Violation—Enforcement. In the event of any action to enforce this <br /> Agreement by either party, or on account of any asserted default or breach of this <br /> Agreement by Anthem, the prevailing party shall be entitled to receive an award of its <br /> costs and attorney's fees in addition to any other relief to which it may be entitled. The <br /> venue for such action shall be Snohomish County Superior Court. Further, if construction <br /> and use of the Property is found by the Court to be inconsistent with the terms of this <br /> Agreement, the City shall be entitled to request that the Court order that all entitlements <br /> 3 <br />
