VALLEY BID PROTEST COUNCIL PRESIDENT SCRIPT April 6,2016/Item 10 Introduction The next item is a bid award regarding the 41st Street to West Marine View Drive Corridor Improvements Project. The apparent low bidder is Valley Electric. However, the recommended bid award is to Marshbank Construction as the lowest responsive and responsible bidder. Council Decision Options: l/t 1 (Staff Recommendation): Reject Protest, Reject Valley bid, and Award to Marshbank: Amended Action Item/Motion: Reject the Protest from Valley Electric, Reject the Bid from Valley Electric as Non-Responsive, and Award the contract bid for the 41st Street to West Marine View Drive Corridor Improvements Project to Marshbank Construction of Lake Stevens,Washington, in the amount of$2,758,753, including Washington State sales tax. 2. Holdover for later Council Meeting. This is because any action other than award to Marshbank does not have WSDOT concurrence. Since the project is federally funded,that concurrence is required. If Council wants to do something other than award to Marshbank(such as reject all bids or award to Valley), staff will need time to study if that is possible and report back to council.
