This specification does not support Valley's position. It pertains only after award and requires
the bidder to provide additional information regarding its DBE's. The language highlighted in
the yellow box states that such additional information may not conflict with the information for
each DBE (i.e., Column 4) in the Certification. If the additional information conflicts with the
Certification, then the additional information will be returned for correction. This provision
nowhere suggests that the Certification may itself be revised,by the bidder or by the City.
4. NAICS Codes. It appears that Valley used some incorrect NAICS codes for OMA
Construction. The City has not independently examined this. However, if the codes are
incorrect, this may provide an independent basis for rejection of the Valley bid.
For the reasons set forth above, City staff will recommend to City Council tomorrow night that
City Council reject Valley's protest and reject Valley's bid.
Sincerely,
Ryan L.
