Priority 1: public safety (police, fire and emergency medical services) <br />Subscribers; Subscribers able to interact with control stations in public school <br />districts and public hospitals within Snohomish County; and other public agencies <br />served by compatible radio communication systems; <br />ii. Priority 2: other public agencies with emergency response duties; and <br />iii. Priority 3: other entities, as determined by the Governing Board. <br />Emergency Public Safety Radio System Replacement Project. Notwithstanding anything <br />in this Agreement to the contrary, no Participating Agency assumes the obligation to fund <br />capital costs related to the design, development, construction or maintenance of the Radio <br />System Replacement Project, and neither the full faith and credit or taxing power is pledged <br />by a Participating Agency for such purpose, except as such obligation may be agreed to <br />and specifically set forth in a separate agreement between the Participating Agency and <br />Snohomish County. SECTION 12. BUDGET; ASSESSMENT FORMULA; <br />PAYMENT OF ASSESSMENTS; DELINQUENCIES; RESERVE FUNDS. <br />a. Budget Fiscal Year. The Snohomish County 911 budget fiscal year shall be <br />either the calendar year, or two calendar years, as the Governing Board may determine. <br />c. Budget Approval. The Executive Director shall present a proposed budget <br />to the Governing Board by no later than August 1 preceding the next budget period and <br />the Governing Board shall approve its budget by no later than September 25. Thereafter <br />and in no event later than September 30, Participating Agencies shall be advised on the <br />programs and objectives contained in the proposed budget, of any changes in the User Fee <br />formula(e), and of the required financial participation for each Principal and Subscriber for <br />the following year(s) based upon the proposed budget. Participation by each Principal and <br />Subscriber is contingent upon subsequent legislative appropriation for the following fiscal <br />year. Principals and Subscribers shall promptly notify Snohomish County 911 if it does <br />not approve its budget allocation. Any Principal not approving its full budget allocation <br />(Assessment and cost of any Additional Services it has agreed to purchase) shall be <br />automatically converted to Subscriber status effective the first day of the budget year <br />(whether biennial or annual) for which the Principal did not approve its budget allocation, <br />and subject to penalty as described in Section 12. <br /> d. User Fee Formula. The User Fee formula applicable to Principals for <br />Emergency Communications Services referred to as the “Assessment formula”, shall be <br />initially approved as set forth in Exhibit B to this Agreement. The Assessment formula(e) <br />may be changed from time to time as part of the budget process, and any such changes <br />shall be approved by Supermajority Vote of the Governing Board in accordance with <br />Section 6.i. Additional Services require only Simple Majority Vote of the Governing
