Washington State Prevailing Wages: The Subrecipient shall comply with all applicable provisions <br />of Chapter 39 12 of the Revised Code of Washington concerning prevailing wages, shall provide <br />the City with all documents required therein, and shall pay not less than the prevailing rate of <br />wage to such laborers, workers, or mechan cs in each trade or occupation required for the work, <br />whether performed by the Subrecipient, subcontractors, or other persons doing or contracting to <br />do the whole or any part of the work subject to prevailing wages and contemplated by this <br />Agreement. The execution date of this Agreement shall be the effective date for any prevailing <br />wages required to be paid under this Agreement. The State of Washington prevailing wage rates <br />applicable for this project, which is located in Snohomish County, may be found at the following <br />website address of the Department of Labor and Industries: <br />https //fortress.wa.gov/Ini/wagelookup/prvWagelookup.aspx. <br />"Section 3" Clause <br />Compliance <br />Compliance with the provisions of Section 3 of the HUD Act of 1968, as amended, and as <br />implemented by the regulations set forth in 24 CFR 75, and all applicable rules and orders <br />issued hereunder prior to the execution of this Agreement, shall be a condition of the <br />Federal financial assistance provided under this Agreement and binding upon the City, the <br />Subrecipient and any of the Subrecipient's subcontractors. Failure to fulfill these <br />requirements shall subject the City, the Subrecipient and any of the Subrecipient's <br />subcontractors their successors and assigns, to those sanctions specified by the Agreement <br />through which Federal assistance is provided. The Subrecipient certifies and agrees that no <br />contractual or other disability exists that would prevent compliance with these <br />requirements. <br />The Subrecipient further agrees to comply with these "Section 3" requirements and to <br />include the following language in all subcontracts executed under this Agreement: <br />"The work to be performed under this Agreement is a project assisted under a <br />program providing direct Federal financial assistance from HUD and is subject <br />to the requirements of Section 3 of the Housing and Urban Development Act of <br />1968, as amended (12 U.S.C. 1701) and as implemented by the regulations set <br />forth in 24 CFR 75. Section 3 requires that to the greatest extent feasible <br />o pportunities for training and employment be given to Section 3 workers <br />within the metropolitan area in which the project is located, and where <br />feasible, given to Section 3 workers residing withing the service area or the <br />n eighborhood of the project and to participants in YouthBuild programs. <br />Furthermore that contracts for work awarded in connection with the Section 3 <br />projects are provided to business concerns that provide economic <br />o pportunities to Section 3 workers residing in the metropolitan area in which <br />the project is located and, where feasible, to Section 3 workers within the <br />service area or the neighborhood of the project and YouthBuild programs." <br />Exhibit B - 10 <br />
