ORDINANCE NO t831 <br /> An Ordinace to prevent male persons in the City of Everett, <br /> who are phrsicaily fit to perform some useful service, from <br /> remaining idle euring the period of the war, providing a pen- <br /> ..lty and declaring an emergency. <br /> WHEREAS, it is essential and necessary for the protection <br /> and welfare of the City -of Everett, the State of P _shington <br /> and the United States of A }.erica, because of the existence <br /> of a state of war in which the United States is now engaged <br /> that all things possible be done to aid the nation in the pre- <br /> sent crisis, now therefore, <br /> THE -ITV OF E?r 'RETT DOES ORDAIN <br /> Section 1. It shall be unlawful, dnring the period of the <br /> war, for any male person in the City of Everett, who is <br /> physically fit to perform' some useful service , to remain idle <br /> and all such persons shall, during such period be habitually <br /> and regularly engaged in some lawful, useful and recognized <br /> business, profession, occupation, trade or employment, and any <br /> person refusing to be so employed shall be deemed guilty of a <br /> violation of this ordinace and shall, ?son conviction thereof <br /> in the Police Court, be punished by a fine not exceeding f100 <br /> or by imprison_: ent in the city jail for a period not exceeding <br /> thirty days, or by both such fine end imprisonment. In no case <br /> shall the possession by the accused of money, property or income <br /> sufficient to support himself and those regularly dependent upon <br /> him be a defense to any prosecution under this ordinance . <br /> Section 2 . In no case shall the claim by the accuse''_ of <br /> his inability to obtain work or employnent be a defense to a <br /> prosecution hereunder unless it shall be proved that the accused <br /> promptly notified 'he E ployment Agent of the City of Everett <br /> of his inability to obtain enployment and requested that work <br /> or employment be found for him and that such employment was not <br /> furnished him, and shall hold a certificate from said agent that <br /> such application has been made. <br /> Section 3 . It shall be the dj_ ty of the Esid E _ploy -_ent Agent <br /> whenever any person -hall inform him of his i sbiiity to obtain <br /> employment as aforesaid to register forthwith ' he name of such <br /> person in the Employment Office, together with hi address, , age, <br /> and any other information which he may deer-. necessary. The <br /> Employ-rent Agent shall thereupon assign, or cause to be assignee <br /> and, if necessary, re-assign or . -_u ;e to be re-assigned, such <br /> persons to occupations as aforesaid, earried on by the City of <br /> Everett, by the State, or any county or municipality thereof, or <br /> by private employers, engaged in agricultural, industrial or <br /> other occupation of the character above mentioned, and who accept <br /> the services of such persons; provided, however, thet no person <br />
