2025 PAVEMENT MAINTENANCE OVERLAY SPECIAL PROVISIONS <br />PW# 3830 <br /> SP-25 March 26, 2025 <br /> <br />1-07.18(5)J.RTF 1 <br />1-07.18(5)J Pollution Liability 2 <br />(January 4, 2016 APWA GSP) 3 <br /> 4 <br />The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for 5 <br />claims involving bodily injury, property damage (including loss of use of tangible property 6 <br />that has not been physically injured), cleanup costs, remediation, disposal or other handling 7 <br />of pollutants, including costs and expenses incurred in the investigation, defense, or 8 <br />settlement of claims, arising out of any one or more of the following: 9 <br />1. Contractor’s operations related to this project. 10 <br />2. Remediation, abatement, repair, maintenance or other work with lead-based paint or 11 <br />materials containing asbestos. 12 <br />3. Transportation of hazardous materials away from any site related to this project. 13 <br /> 14 <br />All entities listed under 1-07.18(2) of these Special Provisions shall be named by 15 <br />endorsement as additional insureds on the Contractors Pollution Liability insurance policy. 16 <br /> 17 <br />Such Pollution Liability policy shall provide the following minimum limits: 18 <br />*** $2,000,000 *** each loss and annual aggregate 19 <br /> 20 <br />1-07.18(5)K.RTF 21 <br />1-07.18(5)K Professional Liability 22 <br />(December 30, 2022 APWA GSP) 23 <br /> 24 <br />The Contractor and/or its subcontractor(s) and/or its design consultant providing construction 25 <br />management, value engineering, or any other design-related non-construction professional 26 <br />services shall provide evidence of Professional Liability insurance covering professional 27 <br />errors and omissions. 28 <br /> 29 <br />Such policy shall provide the following minimum limits: 30 <br />$1,000,000 per claim and annual aggregate 31 <br /> 32 <br />If the scope of such design-related professional services includes work related to pollution 33 <br />conditions, the Professional Liability insurance shall include coverage for Environmental 34 <br />Professional Liability. 35 <br /> 36 <br />If insurance is on a claims-made form, its retroactive date, and that of all subsequent 37 <br />renewals, shall be no later than the effective date of this Contract. 38 <br /> 39 <br />1-07.23.GR1 40 <br />Public Convenience and Safety 41 <br /> 42 <br />1-07.23(1).GR1 43 <br />Construction Under Traffic 44 <br /> 45 <br />1-07.23(1).INST1.GR1 46 <br />Section 1-07.23(1) is supplemented with the following: 47 <br /> 48 <br />f1-07.23(1).OPT5.docx 49 <br />(February 6, 2023) 50 <br />Lane, ramp, shoulder, and roadway closures are subject to the following restrictions: 51 <br /> 52
