STATE & LOCAL SALES TAX: The above submitted prices do not include State or Local Sales Tax but do include all the other applicable taxes. D. OVERHEAD & PROFIT: The Undersigned agrees that the submitted bid(s) includes all of Contractor's overhead and profit or fees. E. REINSTATEMENT OF ALTERNATES: The Undersigned agrees that the Owner has the right to reinstate, at the Bid Price, any alternate bid not initially incorporated into the Contract, if the Owner notifies the Undersigned within fifteen (15) days after the initial official Notice to Proceed with Work is issued. F. TIME OF COMPLETION: The Undersigned hereby agrees to commence work under this Contract on or before a date specified to be written in a "Notice to Proceed," to substantially and finally complete the Work within the time specified in the Contract Documents. G. TIME IS OF THE ESSENCE: Time is of the essence for all work to be performed under this Contract. Contractors shall note that the Work must be completed within the time limit stated in the Contract Documents. H. LIQUIDATED DAMAGES: Failure to timely complete this contract will result in liquidated damages pursuant to the Contract Documents. I. CONTRACT & BOND(S): If written Notice of Award is issued to the Undersigned within thirty (30) days after the date of opening of the bids, or at any time thereafter prior to the bid being withdrawn by the Undersigned, the Undersigned agrees to execute and deliver a contract in the form required by the Contract Documents and in accordance with the bid as accepted, with partial payments provided for in accordance with the Contract Documents and the laws of the State of Washington relating to such payments for Public Works (Chapter 60.28 RCW); and to provide the Performance and Payment Bond and required insurance documents as specified in the Contract Documents with good and sufficient insurers, surety or sureties acceptable to the Owner, within ten (10) days after issuance of the Notice of Award, exclusive of the day of notice. J. BID GUARANTEE: The Undersigned further agrees that the postal money order, certified or bank cashier's check, or surety bond (collectively "Bid Guarantee") payable to the Owner, accompanying this proposal, is left in escrow with the Owner; that its amount is the measure of liquidated damages which the Owner will sustain by the failure of the Undersigned to execute and deliver the above -named Contract and Bond, and that if the Undersigned defaults in executing and delivering that Contract and in providing the Bond and insurance documents within ten (10) days of issuance of Notice of Award, then the Bid Guarantee shall be forfeited to the Owner; but if this bid is not conditionally accepted by the Owner within thirty (30) days of the time set for the opening of bids, or if the Undersigned executes and delivers said Contract, insurance documents and Bond, the Bid Guarantee shall be returned to the Undersigned. K. ADDENDA: Receipt of addenda numbered through is hereby acknowledged. L. SUBCONTRACTOR LISTS: For those projects where the Owner's estimate of the cost of the work is one million dollars or more, the Contractor shall submit the following in a manner consistent with the requirements of RCW 39.30.360: 1.
