' SNO-ISLE TECH 2O23 SMALL WORKS Section 00 70 00, Page 13 <br />McGRANAHAN ARCHITECTS GENERAL CONDITIONS <br />Y Whenever Contractor has knowledge of any actual or potential labor dispute which may in any way <br />affect, delay or arise in connection with or as a result of the performance of this Contract, Contractor <br />will immediately notify and submit relevant information to Owner. <br />3.5 WAGES AND BENEFITS <br />3.5.1 This Contract is subject to the wage and hour requirements of RCW 39.12 and RCW 49.28 (as <br />amended or supplemented). The Contractor, each Subcontractor and other person doing any work under <br />this Contract shall pay laborers, workmen or mechanics not less than the prevailing rate of wage for an <br />hour's work in the same trade or occupation in the locality within the state of Washington where such <br />labor is performed. Contractor and each Subcontractor shall comply with legal requirements concerning <br />submission of certified payrolls to the Department of Labor and Industries of the state of Washington. <br />Wages and benefits higher than the minimums required by law may be paid. It is the contractor's sole <br />responsibility to determine the wage rates it will actually have to pay. In the event rates of wages and <br />benefits change while this Contract is in force, the Contractor shall bear the cost of such changes and <br />shall have no claim against the Owner on account of such changes. No claim for additional compensation <br />will be allowed which is based upon a lack of knowledge or a misunderstanding of any such requirements <br />by the Bidder/Contractor or a failure to include in the Bidder's bid price adequate increases in such <br />wages over the term of this Contract. <br />3.5.2 All determinations of the prevailing rate of wage shall be made by the industrial statistician of <br />the Department of Labor and Industries of the state of Washington. The schedule of prevailing wage <br />rates as determined by the industrial statistician for the locality or localities where this Contract will be <br />performed are by this reference made a part of this Contract. The state schedule of prevailing wage rates <br />applicable to the Work, as most recently provided by the state, is set forth in Attachment A following <br />these General Conditions. If employing labor in a class not listed in such schedule, the Contractor shall <br />request the industrial statistician to determine the correct wage rate for that class and locality. To obtain <br />a listing of current minimum wages for any county contact: <br />Department of Labor and Industries <br />201 - 11th Avenue <br />Olympia, Washington 98504 <br />(Telephone: (360) 902-5335) <br />3.5.3 In case any dispute arises as to what are the prevailing rates of wages for work of a similar nature <br />and such dispute cannot be adjusted by the parties in interest, including labor and management <br />representatives, the matter shall be referred for arbitration to the director of the Department of Labor and <br />Industries of the State of Washington and his or her decision therein shall be final and conclusive and <br />binding on all parties involved in the dispute. <br />3.5.4 The Contractor, each Subcontractor and other person required to pay the prevailing rate of wage <br />shall post in a location readily visible to workers at the job site: (1) a copy of the statement of intent to <br />pay prevailing wages approved by the industrial statistician of the Department of Labor and Industries <br />under RCW 39.12.040; and (2) the address and telephone number of the industrial statistician of the <br />Department of Labor and Industries where a complaint or inquiry concerning prevailing wages may be <br />made. <br />mcg-ARC 2120.000 February 28, 2023 <br />
