SNO-ISLE TECH 2O23 SMALL WORKS Section 00 70 00, Page 16 <br />McGRANAHAN ARCHITECTS GENERAL CONDITIONS <br />3.6.2 Warranty work shall remedy defective Work, resultant damage to other Work and include any <br />incidental work related to or required for proper correction. <br />3.7 TAXES <br />3.7.1 The Work to be performed under this Contract constitutes a "retail sale" as such term is defined <br />in RCW 82.04.050, and the contract price is subject to the State of Washington and local retail sales <br />taxes. The bid price shall not include such retail sales taxes. Based on the Contract Sum, Owner will <br />pay retail sales taxes on each progress payment and final payment to the Contractor for transmittal by <br />the Contractor to the State of Washington Department of Revenue. <br />All other applicable taxes which the Contractor is required to pay, excepting State and local retail sales <br />taxes as specified above, shall be included in its proposed prices for the Work under this contract. No <br />adjustment will be made in the amount to be paid by Owner under this contract because of any <br />misunderstanding by the bidder/Contractor as to its liability for or the amount of any taxes or because of <br />any increases in tax rates imposed by any federal, state or local government. <br />3.8 PERMITS, FEES AND NOTICES <br />3.8.1 Contractor shall secure and pay for all permits and governmental fees, licenses and inspections <br />necessary for the proper execution and completion of the Work, including Occupancy Permit, which are <br />customarily secured after execution of the Contract and which are legally required for and during the <br />prosecution of the work and the subsequent warranty period. Owner will secure and purchase only the <br />primary building, mechanical and electrical permits. <br />3.8.2 The Contractor shall comply with and give notices required by laws, ordinances, rules, <br />regulations and lawful orders of public authorities bearing on performance of the Work. <br />3.8.3 If the Contractor observes that the Contract Documents are not in accordance with applicable <br />laws, statutes, ordinances, building codes, and rules and regulations or that portions of the Contract <br />Documents are at variance therewith, the Contractor shall promptly notify the Architect and Owner in <br />writing, and necessary changes shall be accomplished by appropriate Modification. <br />3.8.4 If the Contractor performs Work knowing it to be contrary to laws, statutes, ordinances, building <br />codes, and rules and regulations without such notice to the Architect and Owner, the Contractor shall <br />assume full responsibility for such Work and shall bear the attributable costs, including, but not limited <br />to, fines, penalties, and interest. <br />3.9 ALLOWANCES <br />3.9.1 The Contractor shall include in the Contract Sum all allowances stated in the Contract <br />Documents. Items covered by allowances shall be supplied for such amounts and by such persons or <br />entities as the Owner'may direct, but the Contractor shall not be required to employ persons or entities <br />against which the Contractor makes reasonable objection. <br />mcg-ARC 2120.000 February 28, 2023 <br />
