SNO-ISLE TECH 2O23 SMALL WORKS Section 00 70 00, Page 49 <br />McGRANAHAN ARCHITECTS GENERAL CONDITIONS <br />.6 To such costs shall be added an amount equal to ten percent (10%) thereof as a reasonable amount <br />for overhead, profit, and all other`costs not specifically accounted for above. <br />Within three (3) days after notice of litigation delay under this paragraph, the Contractor shall notify the <br />Owner and Architect in writing of the Contractor's estimated weekly litigation delay costs as described <br />above; provided, however, that in no event will payment for actual litigation delay costs exceed one <br />hundred twenty-five percent (125%) of the said estimated costs. The Contractor shall submit to the <br />Architect no later than the fifth day of each month a request for such litigation delay costs incurred during <br />the previous calendar month. The request for payment shall be in a form satisfactory to the Architect <br />and Owner and shall include copies of invoices, correspondence and such other verifiable evidence of <br />delay costs actually and necessarily incurred by the Contractor as the Owner or Architect may require. <br />This paragraph shall be the Contractor's exclusive remedy for litigation delay costs. <br />9.8 SUBSTANTIAL COMPLETION <br />9.8.1 Substantial Completion is the stage in the progress of the Work when the Work or designated <br />portion thereof is sufficiently complete in accordance with the Contract Documents so that the Owner <br />can occupy or utilize the Work for its intended purpose, as determined by Owner and Architect. <br />Substantial completion shall not be granted until commissioning is complete and receipt of a satisfactory <br />HVAC balancing report by Owner. No portion of the Project will be considered substantially complete <br />until the local building, fire and DSHS authorities have issued Certificates of Occupancies and or other <br />approval for occupancy covering that portion of the Work. All of the Project.'s parts and systems shall <br />be accessible, operable and usable by the Owner, including site Work. The Project shall be clean. <br />Preliminary training of personnel must take place. Only incidental corrective Work under "Punch Lists" <br />and final cleaning (if required) may remain to be done. <br />.1 There may be a separate Date of Substantial Completion specified in the Contract Documents for <br />completion of one or more receiving areas to be used by the Owner for receiving assembly and delivery <br />of Owner -supplied items. The Work is not Substantially Complete if all systems and parts are not usable <br />and commissioned, if utilities are not connected and operating normally, or if the Work is not accessible <br />- by normal vehicular and pedestrian traffic routes. The fact that the Owner may occupy the Work or <br />designated portion thereof does not indicate that the Work is Substantially Complete or is acceptable in <br />whole or in part, nor does such occupation toll or change any liquidated damages due the Owner. <br />9.8.2 When the Contractor considers that the Work, or a portion thereof which the Owner agrees to <br />accept separately, is substantially complete, the Contractor shall prepare and submit to the Architect a <br />comprehensive list of items to be completed or corrected. The Contractor shall proceed promptly to <br />complete and correct items on the list. Failure to include an item on such list does not alter the <br />responsibility of the Contractor to complete all Work in accordance with the Contract Documents. Upon <br />receipt of the Contractor's list, the Architect will make an inspection to determine whether the Work or <br />designated portion thereof is substantially complete to assist the Contractor in completing the Work. If <br />the Architect's inspection discloses any item, whether or not included on the Contractor's list, which is <br />not in accordance with the requirements of the Contract Documents, the Contractor shall, before issuance <br />of the Certificate of Substantial Completion,. complete or correct such item upon notification by the <br />Architect. The Contractor shall then submit a request for another inspection by the Architect to <br />mcg-ARC 2120.000 February 28, 2023 <br />
