Information concerning reduction of <br />coverage shall be furnished by the Contractor with reasonable promptness in accordance with the <br />Contractor's information and belief. <br />11.1.4 The Contractor shall furnish one copy each of certificates of insurance herein required for each <br />copy of the agreement which shall specifically set forth evidence of all coverage required by <br />subparagraphs 11.1.1, 11.1.2 and 11.1.3. The Contractor shall furnish to the Owner copies of any <br />endorsements that are subsequently issued amending coverage or limits. <br />11.2 OWNER'S LIABILITY INSURANCE <br />11.2.1 The Owner shall be responsible for purchasing and maintaining the Owner's usual liability <br />insurance. Optionally, the Owner may purchase and maintain other insurance for self-protection against <br />claims, which may arise from operations under the Contract. The Contractor shall not be responsible for <br />purchasing and maintaining this optional Owner's liability insurance unless specifically required by the <br />Contract Documents. <br />11.3 PROPERTY INSURANCE <br />11.3.1 Before commencement of the work, the Contractor will submit written evidence (via certificate <br />of insurance) that it has purchased (at Contractor's expense) for the period of this Contract, Builder's <br />Risk "All -Risk" Completed Value Insurance Coverage, in the face amount of this Contract plus state and <br />local sales taxes, (including coverage for fire, Collapse, and Damage resulting from Faulty <br />Workmanship, Material, or Design; but not including Flood, Earthquake or Landslide unless specified <br />for a given project) upon the entire work which is the subject of this Contract, including completed work <br />and work in progress but excluding structures in existence at the time the Contract was awarded. Such <br />insurance shall include as Additional Named Insureds: The Owner(s) and each of their officers, agents <br />and employees; and any other persons with an insurable interest designated by the Owner as Additional <br />Named Insureds. Such insurance must be issued by an insurer(s) and reinsurers meeting the qualification <br />requirements of subparagraph 11.1.1. Within thirty (30) days of award of the Contract, the Contractor <br />shall also provide the Owner with a copy of the insurance contract required by this Subsection. <br />l <br />Such insurance may have a deductible clause but not to exceed $10,000. (The deductible on earthquake, <br />flood and landslide may be in accordance with the Underwriters' requirements.) The Contractor shall be <br />solely responsible for any such deductibles. <br />11.3.2 Adjustment. Upon the occurrence of an insured loss, the Owner, as first named insured, shall <br />have the right to adjust and settle any loss with the insurers. The Owner shall deposit in a separate <br />account any monies received, and shall distribute such funds in accordance with such agreement as the <br />parties in interest may reach. If no agreement is reached, any damaged Work shall first be repaired or <br />replaced, and payment therefor made from the separate account by Change Order or by payment to a <br />separate contractor, at Owner's option; further disbursements from the separate account will then be <br />determined pursuant to the provisions of subparagraphs 4.4 and 4.5 above. <br />mcg-ARC 2120.000 February 28, 2023 <br />
