The <br />Contractor shall not be required to extend credit to any buyer, and may acquire any such property under <br />the conditions prescribed by and at a price or prices approved by the Owner, and the proceeds of any <br />such transfer or disposition may be applied in reduction of any payments to be made by the Owner to <br />the Contractor; <br />.8 take such action as may be necessary or as directed by the Owner to preserve and protect the <br />Work and property related to this Project in the possession of the Contractor in which the Owner has an <br />interest; and <br />.9 continue performance only to the extent not terminated. <br />14.4.2 The Contractor shall, from the effective Date of Termination until the expiration of three (3) <br />years after final settlement under this Contract, preserve and make available to the Owner, at all <br />reasonable times at the office of the Contractor, and without charge to the Owner, all books, records, <br />documents, photographs and other evidence bearing on the costs and expenses of the Contractor under <br />this Contract and relating to the terminated or completed Work. <br />14.4.3 In arriving at any amount due the Contractor after termination, the following shall apply: <br />.1 The Contractor shall refund to the Owner any amounts paid by the Owner to the Contractor in <br />excess of costs reimbursable under paragraph 14.3. <br />.2 The damages and relief from termination by the Owner specifically provided in Article 14 shall <br />be the Contractor's sole entitlement in the event of termination. <br />END OF SECTION <br />mcg-ARC 2120.000 February 28, 2023 <br />
