(Everett Project) Dear Mr. Meyer: We have reviewed your application to directly impact 923 square feet (sf) of wetland (Wetland A) and indirectly impact 2,886 sf of wetland (Wetlands F and J)at 4000 Seaway Boulevard at Everett, Washington. Based on the information you provided to us, Nationwide Permit (NWP) 39, Commercial Development (Federal Register January 13, 2021, Vol. 86, No. 8), authorizes your proposal as depicted on the enclosed drawings dated December 4, 2020. In order for this authorization to be valid, you must ensure the work is performed in accordance with the enclosed NWP 39, Terms and Conditions and the following special conditions: a. You shall implement and abide by the Mitigation Plan, prepared by Talasaea Consultants, Inc. dated February 3, 2021 and revised April 22, 2021, and obtain 923 square feet of mitigation bank credits from the Skykomish Habitat Wetland Mitigation Bank in accordance the Mitigation Plan. b. You shall obtain from the Skykomish Habitat Wetland Mitigation Bank sponsor documentation of the completed mitigation bank transaction. You shall submit to the U.S. Army Corps of Engineers, Seattle District, Regulatory Branch documentation on the completed mitigation bank transaction prior to performing work in waters of the U.S. authorized by this permit. All submittals must prominently display the reference number NWS-2021-430. c. You shall implement and abide by the Mitigation Plan, prepared by Talasaea Consultants, Inc. dated February 3, 2021 and revised April 22, 2021.
